4. AUTHORITY CITED:

10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. REASON FOR AUTHORITY CITED:

(a) As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. The following subparagraphs provide the rationale for use of the authority under FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. Paragraph 6.302-1(a)(2)(ii)(A) and (B) applies when the agency’s need for the supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) substantial duplication of cost to the Government that is not expected to be recovered through competition, or (B) unacceptable delays in fulfilling the agency requirement.

FAR 6.302-1(a)(2)(ii)(A) Duplication Costs: A substantial duplication cost of would be incurred if another vendor were sourced to complete this requirement. DRS is the current provider of the FCC for the M119A3 Howitzer. In addition, other platforms requiring enhanced tactical computer solutions such as the M777A2 howitzer and M109A5 Paladin have identified the DRS computer as a mature system that may replace current, soon to be obsolete, computing equipment. DRS is the only entity with the necessary knowledge and experience to deliver the FCC in time to support the fielding of the M119A3 Howitzer without incurring substantial duplication costs. Due to the fielding of thousands of DRS computers, extensive testing has been done on existing military systems and only the DRS FCC has the computing power and survivability required for the dramatic shock environment of the M119A3 Howitzer. It is estimated that it would cost in duplication costs, which would not be recovered through competition. DRS has mastered the fabrication of the ruggedized components design built to withstand the unique stress points on the towed artillery weapons and be interoperable with military standard tactical information systems. The duplication costs are estimated based upon an engineering estimate of the need for another vendor to quality a common system to be utilized on several platforms. The Government would incur duplication costs for the non-recurring engineering involving Functional Baseline Analysis, Baseline Design, Prototyping, Detail Design, Design Verification & Validation, and Systems Qualification. The labor hours below show how only the unique capability offered by the DRS FCC can meet the Government’s delivery schedule and performance requirements. The duplication costs are as follows:

1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a market survey, W15QKN-17-X-081J, was posted to FedBizzOpps on 28 November 2016 and closed on 28 December 2016. No official responses of interest were received during this time. The Government maintains constant communication with companies concerning similar projects and has knowledge of each company’s capabilities through meetings, visits, trade shows and continuing discussions on several projects.

Additionally, literature research of potential vendors from previous competition confirms the capabilities that are offered by the vendors. As a result, it is recommended that this action be solicited as a sole source because of the substantial duplication cost and schedule delays outlined above.

The use of commercial or Non-Developmental Items will increase the available future options for competition for the next generation of Fire Control Computing solutions.

(6) Patterns: There are no unusual patterns revealed by the previous procurement history.

(7) Significant Changes: There have been no significant changes since the previous procurement. DRS is the only source that possesses the requisite level of expertise and experience to provide a FCC that will meet the required delivery schedule without substantial duplication costs incurred. This action increases the ceiling amount available to procure additional FCCs under the current contract.

APPROVAL

Based on the foregoing justification, I hereby approve the procurement of M119A3 Fire Control Computers (FCC) on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c)(1); FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, subject to the availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
