CISAM 3008.405-690(a)(2) - Limited-Sources Justification (LSJ)
LSJ No: FY23-0065 Page 2 of 3
FAR 8.405-6 (a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
Rationale:
Due to delays in granting Entry On Duty (EOD) for VIPER personnel the program office is in need for Slalom to continue to provide critical expertise in certain labor categories which they’ve been providing support for the past 3 years. There have been delays by both the contractor and the government regarding having cleared personnel be able to perform on VIPER. There remains a significant number of critical positions to be cleared through OSI. This is to bolster the technical expertise available through the VIPER contract with Business Analysts, QE Automation, XD Support, Data Engineering and Technical Leadership. Slalom is the only contractor that has the experience, expertise and EOD staff that can provide support in these functional areas.
Even though market research has demonstrated that there are other contractors capable of accomplishing the work, they would not be able to EOD the positions required in time to continue maintain this mission critical work. The additional time is required to ensure that the USCIS has adequate support for these critical labor categories.
Without these critical labor categories the USCIS Verification Information System (VIS) and related programs such as E-Verify and Systematic Alien Verification for Entitlements (SAVE) program could experience outages and degraded services. Without these mission critical services the SAVE and E-Verify programs could experience outages or degraded services. Without SAVE federal, state, and local benefit-granting agencies would not be able to verify a benefit applicant’s immigration status or naturalized/derived citizenship. E-Verify an internet-based system in partnership with the Social Security Administration companies and federal contractors would not be able verify the legal status employment eligibility of an individual.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed Task Order to Slalom LLC for the additional technical expertise required to maintain VIS, E-Verify and SAVE represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
The market research for the VIPER award was reviewed and there have been no significant changes in the market place.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for the supplies or services is made.
