Center, Jackson, MS Purchase Request: 586‐18‐1‐047‐0001
2. Nature and/or Description of the Action Being Processed:
A new Firm‐fixed‐price contract for a Maquet Magnus Hybrid OR table system for the new hybrid OR at the G.V. (Sonny) Montgomery VAMC, Jackson, MS.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The G.V. (Sonny) Montgomery VAMC is in need of a Maquet Magnus table system for the new Hybrid OR currently in renovation. The system is comprised of twelve components.
4. Statutory Authority Permitting Other than Full and Open Competition:
(x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302‐1;
( ) (2) Unusual and Compelling Urgency per FAR 6.302‐2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302‐3;
( ) (4) International Agreement per FAR 6.302‐4 ( ) (5) Authorized or Required by Statute FAR 6.302‐5;
( ) (6) National Security per FAR 6.302‐6;
( ) (7) Public Interest per FAR 6.302‐7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The G.V. (Sonny) Montgomery VAMC is in need of a Maquet Magnus Hybrid OR Table system for the Hybrid OR that is currently being constructed. The Maquet Magnus Hybrid OR table system consists of 12 components that when combined interface with Siemens and Stryker equipment (both already purchased) to comprise a surgical system that allows for a comprehensive team of surgeons, interventionalists, nurses, anesthesiologists, and technicians to work seamlessly together. Per FAR 6.302‐1, Maquet has shown that they are the only responsible source that can provide the highly specialized table and components to intergrate with the major system equipment that has been already purchased. To source a surgical table from any other vendor would result in a susbstantial
OFOC SOP Revision 06 Page 2 of 4
Revision 06 Date: 08/30/2017 duplication of cost to the government in that the Siemens equipment order will need to be changed in order to accommodate a different surgical table. Also duplication of cost would occur in the redesign of both the constructin project that renovates the area and the Seimens components.
Further, unacceptable delays would occur in the construction project if redesign of the construction project or Seimens equipment is necessary.
In order to provide surgical care tha tis truly patient centered to our patient population it is in the best interest of the facility and the facility’s patient population to have a table that has the ability to integrate and communicate with the Seimens Artis Zeego system. This will help decrease surgeon, anesthesiologist, nurse, interventionalist, and technician fatigue. This will allow them to provide superior surgical services with state of the art equipment. The table allows the surgeon to reposition the patient without having to move equipment. This allows for the reduction of procedure time and will allw the facility to better utilize the room. Maquet is the sole manufacturer of a table that is designed to be compatible with the Artis Zeego System. The table was designed in conjuction with Seimens, the manufacturer of the Artis Zeego System.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
A sources sought synopsis was issued on September 20, 2017 via FBO. The synopsis was issued as VA256‐17‐N‐1441. The synopsis provided the items, description of the items, the quantity, and delivery location. The synopsis requested the confirmation of the capability of a firm to provide the items, their socioeconomic status of the firm, and if they carried the products or the equivalent of the product. If the firm was providing an equivalent, they were asked to provide cut sheets or product descriptions. No responses were received.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
The cost to the government of $394,936 will be considered fair and reasonable based on comparision to the IGE. Also past purchases will be reviewed to assist in the fair and reasonable determination.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
An RFI was posted requesting socioeconomic and capability information from interested parties.
There were no repsonses received regarding the RFI.
A search of GSA advantage and GSA eLibrary was performed. GSA Advantage did not produce results of the product or similar products. The search of GSA eLibrary showed Maquet as a vendor with a contract, however review of the schedule showed that the Magnus table was not available via a GSA contract.
FPDS was searched and revealed two past NCO 16 contracts for Magnus Hybrid OR tables. The most recent of these contracts was VA256‐16‐P‐0426 awarded February of 2016. This acquisition was posted on GSA without any response to the RFQ. It was then synopsized and solicited via FBO and only received one response to the solicitation. The response was from the manufacturer. The award was made to the manufacturer, Maquet.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The Maquet Magnus Hybrid OR Table system has been chosen by the biomedical department as the manufacturer of the already ordered equipment (Seimens) has designed the ordered system of equipment around the Magnus Hybrid OR table system. The manufacturer of the Magnus Hybrid OR Table, Maquet, and Siemens have partnered to combine the Magnus table with the Artis zeego angiography system to create an offering for the hospital that allows them to use the same OR suite for diagnostic imaging as well as for performing surgeries. Maquet is one of the world’s leading providers of medical products for operating rooms, cath labs, and intensive care units, and has extensive experience with hybrid operating rooms. This puts it in an excellent position to offer hospitals end‐to‐end solutions that meet and exceed the most demanding requirements. This boosts efficiency, optimizes workflow, and increases throughput.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
RFI VA256‐17‐N‐1441 was issued September 20, 2017 via FBO. No sources responded via the RFI.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
An RFI, VA256‐17‐N‐1441, was issued September 20, 2017 via FBO. FPDS was queried in order to ascertain if past contracts had been awarded to the contractor and for the item. FBO was searched to identify past actions (RFI’s, Solicitations, etc) for similar or like items. Google was utilized to attempt to find an equivalent item to seek out their manufacturer. The web page of Seimens, the manufacturer of the previously purchased equipment that this requirement will be intergrated with was also accessed to ascertain if any other product could be used in the configuration.
12. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
