JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724

2. Description of Action: The proposed sole source action is for a one year bridge with Eaton Corporation, 8609 Six Forks Rd., Raleigh, NC 27615 for a firm fixed-price modification to contract VA 118-16-C-0864 to continue corrective and preventative maintenance for brand name Eaton Corporation components of its uninterruptible power supply (UPS) and power distribution unit (POU) systems to allow for a follow-on contract to be awarded.

3. Description of the Supplies or Services: The proposed action is to provide continued corrective and preventative maintenance as well as standby support services for brand name Eaton Corporation components of its UPS and POU systems, valve-regulated lead-acid batteries, Input/output electrical switchgear and battery management system located at the Austin Information Technology Center (AITC) facility at 1615 Woodward Street, Austin, Texas 787 41. The total estimated price of the proposed action is XXX The period of performance shall be February 3, 2020 through February 2, 2021.

4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements".

5. Rationale Supporting Use of Authority Cited Above: Eaton Corporation confirmed that it does not train, certify or support independent third party service providers to deliver or service any of the Eaton UPS and power quality products located at the AITC facility. Additionally, no other service provider is authorized to possess Eaton proprietary (copyrighted) software, repair documentation, processes or materials. Without proper maintenance of the UPS and POU systems, AITC would be vulnerable to any interruption of power or power outage, rendering the AITC unable to continue operations in support of critical systems providing healthcare and benefits to Veterans during these times.

6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any

. additional sources that can meet the Government's requirements. There is no competition anticipated for this modification to extend services.

Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR 5.201. Any proposals received shall be·evaluated.
