About this file

This document is a justification and approval for other than full and open competition regarding a federal contract opportunity for the procurement of main diesel engine parts for the USNS William Mclean. The Navy's Military Sealift Command in Norfolk, Virginia requires two 6,000-hour overhaul kits and additional parts for engines 1 through 4 from the original equipment manufacturer, Man Diesel Germany, or their authorized suppliers Fairbanks Morse Engine and Motor Services Hugo Stamp. The parts are needed to overhaul the engines during the ship's repair and maintenance period from August 8 to October 13, 2021. Only the OEM and authorized suppliers can provide parts and technical data as required by regulations to ensure engine reliability, safety, and warranty coverage. While the solicitation will be posted publicly, only offers from the OEM or authorized suppliers are anticipated due to the need for original, compliant parts to avoid operational risks to the vessel and crew.

DEPARTMENT OF THE NAVY

DIRECTOR

MILITARY SEALIFT COMMAND NORFOLK

471 E. C STREET

NORFOLK, VA 23511

JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command-Norfolk (MSC), 471 East C. Street Norfolk, Va. 23511.

2. Description of Action Being Approved: MSC Norfolk has a requirement for OEM

Main Diesel Engine parts – Flexible hoses, resilient mounts, lube oil feed pipe, and 6k overhaul kits. Total Estimate.

3. Description of Supplies/Services: This requirement covers the procurement of Two (2) 6,000

HR overhaul kits and Main Diesel Engine parts for the USNS WILLIAM MCLEAN (T-AKE

12) Main Diesel Engines #1-4 from the OEM, or authorized OEM providers only. These parts are needed for the overhaul of these engines during the WILLIAM MCLEAN’S ROH-DD, with period of performance of AUG 8 – OCT 13 2021.

4. Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority for this procurement is the test program for commercial items (Section 4202 of the Clinger Cohen Act of 1996) implemented at FAR 13.501 and FAR 13.106-1(b).

5. Rationale Justifying Use of cited Statutory Authority: Under Military Sealift Commands

Safety Management System Procedure Number: 10.6-002-ALL, lists all four main propulsion diesel engine (MPDE) as critical equipment. The engine OEM is Man Diesel, Germany for the T-AKE class ships. Fairbanks- Morse Engine (FME) and Motor-Services-Hugo-Stamp (MSHS) are the OEM authorized suppliers of approved repair parts for T-AKE class main engines. There are no other known vendors who may provide these engine parts. Failure of one MPDE will force the ship to reduce their speed. The loss of two engines put the ship in a c-4 status, thus becoming unable to perform the primary mission of providing underway replenishment services to the fleet, which will result in a CASREP. The reduction of speed can also pose a hazard to the crew, due to limited ship maneuverability. Proper refurbishment and maintenance of engines are critical to the safe operations of T-AKE vessel. FME and MSHS provide parts and technical data / drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures engine reliability, and crew safety

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The solicitation will be posted to GPE on beta.sam.gov for 15 days, however, it is anticipated that offers will only come from the OEM and its authorized vendors.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3.

8. Actions to Remove Barriers to Future Competition: Currently the OEM and its authorized vendors are the only viable source for the requirement. MSC is committed to researching alternatives within the market place in an attempt to develop competition amongst all possible vendors.
