Solicitation: ORA-2024- 123873

This acquisition is issued under FAR 13 Simplified Acquisition as a Request for Quote (RFQ).

The US Food & Drug Administration (FDA) intends to issue a Commercial Item Firm Fixed-Price order that meets the requirements herein.

Period for Acceptance of Quotes: The quoter agrees to hold the prices firm for 60 calendar days after quote due date.

Quotes that do not provide pricing for all line items may be deemed non-responsive.

The Atlanta Human and Animal Food(ATLHAF) Laboratory has a requirement for the rental and laundry service of laboratory coats. ATLHAF is seeking to establish a firm fixed price contract for One Base Year to include 4 one- year option periods.

Requirements/Deliveries The Contractor shall provide all resources necessary to accomplish the tasks and deliverables described in this Statement of Work. The Contractor shall provide weekly rental and laundry services for 54 Lab Coats.

The contractor shall meet the following minimum requirements:

· The contractor shall furnish (F.O.B. Destination within consignee’s premises), all supervision, labor, equipment, materials, supplies and transportation necessary to provide laboratory coats for employees located at the Food and Drug Administration (FDA), 60 8th Street NE, Atlanta, GA 30309.

· The unit cost per employe shall remain the same as the number of employees shall increase or decrease at any time.

· The contractor shall expected to provide a minimum of 525 coats

· Weekly costs shall be adjusted based on the number of uniforms provided at the unit cost per employee indicated in the Price Schedule.

· The contractor shall ensure the laboratory coats are white and present a clean neat professional appearance.

· The contractor shall ensure the laboratory coats are of a washable fabric that absorbs, deflect splashes and spills to keep harmful materials away from the skin,

· The contractor shall provide laboratory coats with snap buttons for quick release and secured protection to stay closed while in use.

· The contractor shall provide coats with an attached FDA Logo to the left outside breast of the coat

· Coats shall have the individual name and discrete inventory number affixed to each coat and labeled inside coat collar.

· The contractor shall be responsible for the cleaning of laboratory coats and repair from “normal wear and tear”.

· The Contractor shall inspect all garments for minor tears, seam flaws, missing buttons, loose emblems, prior laboratory coats being returned. Note: Normal wear and tear is defined as “the physical deterioration which occurs in the normal use for which the garment is intended, without negligence, carelessness, accident or abuse of the garment by the employee.

· Contractor shall automatically replace laboratory coats when they become worn through use or when a size change is necessary. There shall be no additional charge for uniform replacement or changing from one size to another.

· The contractor shall provide laboratory coats that have elastic wrist cuffs at the end of the sleeves.

· The contractor shall ensure all laboratory coats have pockets for pens, notes and keys

· The contractor shall deliver within 10 days of award a combination of sample size coats ranging from small, medium, large, x-large, 1X and 2X, 3X, 4X, 5X Unisex Sizes for fitting. Within 7-10 days of delivery of the sample coats, the COR/COR designee will return a COR approved list of names and sizes to the contractor for 54 laboratory coats.

· Contractor shall establish a uniform inventory listing by individual employee along with type, size and pieces issued. The Contractor shall adjust uniform allocations based on employee turnover by removing uniforms when an employee leaves and outfitting new employees as they are hired. The outfitting of any new employee must be coordinated through the FDA COR.

· The contractor shall deliver all of the COR approved list of rental lab coats no later than 6 -8 weeks after date of award.

· Contractor shall provide a bin for placement of soiled uniforms upon the first delivery of laboratory coats.

Period of Performance The Period of Performance shall begin the date of contract award execution.

Inspection and Acceptance The COR and /or COR designee will perform inspection and acceptance of equipment, installation and services to be provided. The COR and /or COR designee – to be determined upon contract award.

A final inspection and acceptance of all work performed, reports and other deliverables will be performed by the COR and /or COR designee to ensure the services/products provided meet the requirements of the Statement of Work (SOW), and the Contractor shall make changes as requested during the inspection and acceptance process.

Inspection and acceptance will occur at the place of performance and take place within five (5) business days of task being completed. The Government will provide written notification of acceptance or rejection within five (5) business days. Inspection will include review of the deliverables to ensure adequacy.

The Government will accept goods, reports, and services only if they conform to all terms and conditions of the SOW, and satisfy the performance standards developed under this SOW.

The Government will reject non-conforming products and services. The Contractor shall correct any deficiencies within fifteen (15) business days of when the Government issues the rejection notice. If the Contractor cannot correct the deficiencies within this period, the Contractor shall immediately notify the COR of the reason for the delay and provide a proposed corrective action plan within five (5) business days.

To be determined Contracting Officer Authority The Contracting Officer (CO) is the sole person authorized to make or approve any changes in any of the requirements of this order and notwithstanding any provisions contained elsewhere in the order, the said authority remains solely with the CO. In the event the Contractor makes any changes at the direction of any person other than the CO, the change shall be considered to have been made without authority and no adjustment will be made in the delivery order terms and conditions, including price. The CO shall be the only individual authorized to accept nonconforming work, waive any requirement of the order and modify any term or condition of the order. The CO is the only individual who can legally obligate Government funds.

The Contracting Officer’s Representative (COR) or Project Officer is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the order price, terms or conditions. The COR/Project Officer is responsible for the technical aspects of the project and serves as technical liaison with the contractor and is responsible for the final inspection and acceptance, and such other responsibilities as may be specified in the order.

ORDER OF PRECEDENCE

The contractor shall follow the terms and conditions of this order. Should the contractor include any additional terms and conditions resulting in conflicts between this document and the contractor’s document, the order of precedence shall be as specified in FAR Clause 52.212-4 of the contract. Any indemnification language indemnifying the contractor of any liability and governing law language in the contractor’s terms and conditions shall be invalid and shall be stricken and removed from this order. Any additional terms and conditions shall not be prohibited by applicable laws and regulations. Any additional terms and conditions identified with a web link and/or incorporated by reference shall be stricken and removed from this order.

The provision at 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services (SEP 2023), applies to this acquisition and with the following addenda:

PROPOSAL SUBMISSION FORMAT:

*The solicitation does not commit the Government to pay any cost for the preparation and submission of a quote or proposal. It is also advised that the Contracting Officer (CO) is the only individual who can legally commit and obligate the Government to the expenditure of public funds in connection with the proposed acquisition.* The offeror or applicant shall submit all electronic documents for Microsoft Office suite products without the use of “macros”. When submitting proposals via email, DO NOT include .exe,.mso, or any other executable file types that could potentially trigger email security protections (i.e. email blocks, quarantine). If the offeror or applicant submits documents that contain macros, macro referenced files, and/or executable files, the Government will not be able to view or open such documents and the submission will be considered non-responsive to the solicitation. No additional time will be given to an offeror or applicant to correct the document submission and the Government will not inform the offeror or applicant that their submission is non-responsive prior to award. It is the offeror’s or applicant’s responsibility to ensure all electronic documents are submitted without the use of macros.

The provision at 52.212-2, Evaluation—Commercial Items (NOV 2021), is applicable to this requirement. The specific evaluation criteria to be included in paragraph (a) of that provision are as follows:

The Government will award a firm fixed priced contract resulting from this solicitation to the responsible quoter whose quote meets the requirements listed under this solicitation and is the lowest priced quote received in response to this solicitation. The quoter shall submit pricing in accordance with section v of this solicitation. Quotes that do not pricing for all line items may be deemed non-responsive.

Therefore, award will be made to quoter whose quote is determined to be Lowest Price Technically Acceptable. The Government intends to evaluate quotes and award an order without discussions. Quoters' initial quote should contain the Quoters’ best terms from a price standpoint as well as demonstrate the ability to meet the solicitation requirements. If the contractor fails to demonstrate the solicitation requirements than it will be deemed technically unacceptable.

A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (MAY 2024), applies to this acquisition. The quoter shall complete only paragraph (b) of this provision if the quoter has completed the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal.

The clause at 52.212-4, Contract Terms and Conditions—Commercial Items (NOV 2023), applies to this acquisition with the addenda for invoicing instructions as stated in section “Order Administration”.

The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders—Commercial Items (MAY 2024), applies to this acquisition.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

HHSAR 352.232-71 Electronic Submission of Payment Requests (FEB 2022)

(a) Definitions. As used in this clause- Payment request means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Content of Invoices" and the applicable Payment clause included in this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Department of Treasury Invoice Processing Platform (IPP) or successor system. Information regarding IPP, including IPP Customer Support contact information, is available at www.ipp.gov or any successor site.

(c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with HHS procedures.

(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting Officer's written authorization with each payment request.

(a)Pursuant to Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d), as amended by the Workforce Investment Act of 1998, all electronic and information technology (EIT) supplies and services developed, acquired, or maintained under this contract or order must comply with the “Architectural and Transportation Barriers Compliance Board Electronic and Information Technology (EIT) Accessibility Standards” set forth by the Architectural and Transportation Barriers Compliance Board (also referred to as the “Access Board”) in 36 CFR part 1194.
