JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Military Sealift Command (MSC), Norfolk
2. Description of the Action Being Approved: Award of a firm-fixed price contract on a sole source basis for Original Equipment Manufacturer (OEM), Turbo Systems US Inc (formerly ABB Turbocharging, Inc.) parts in support of T-AO Class Ships.
3. Description of Supplies/Services: MSC requires the following OEM parts from Turbo Systems Inc:
Three (3) Ship Sets – Total of 12 VTR 454-11 Turbo Chargers with ABS Survey Certificates
The total estimated value of this requirement is to be executed under this
J/A using United States Navy Working Capital Funds (NWCF).
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C.
2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements
5. Rationale Justifying Use of Cited Authority: There are currently eleven (11) active T-AO vessels in the MSC fleet with Colt-Pielstick 10PC4.2V with Turbo System US Inc (formerly ABB Inc – Asea brown-Boveri) turbos and associated parts. These systems are required for propulsion and failure of which would result in the vessel not being able to perform its required national defense mission. SMS Number 10.6-002-ALL “Identification of Critical Equipment” has labeled these systems/items as L4 critical equipment; on a scale from L1 to L4 with L4 being the most critical. It is required “To ensure that vessel equipment is repaired/maintained in accordance with regulatory body requirements, MSC Policy, and OEM recommendations.” as stated in SMS number 10.4-001-ALL “Preventive Maintenance (PM)” and SMS Number 10.7-001-ALL “Corrective Maintenance”. Turbo Systems US Inc (formerly ABB Inc) provides proprietary technical data/drawings for these systems/parts as required by United States Coast Guard (USCG) and American Bureau of Shipping (ABS) regulations and are the only authorized manufacturer and distributor of these OEM required supplies and services or have obtained the rights from the OEM to provide the supplies and services. Competition will be limited to Turbo Systems US Inc (formerly ABB Inc) who is the OEM of the required supplies.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: In accordance with FAR 5.201 (b)(1)(i), the Government intends to issue a synopsis and solicitation on the Government wide point of entry (GPE) SAM.GOV, with the intent of awarding a firm fixed price contract.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3
8. Actions to Removed Barriers to Future Competition. For reasons set forth in Paragraph 5, Turbo Systems Inc parts are required. Should MSC determine that Turbo Systems parts are no longer required; this J&A will become null and void.
