This is a request for quote for commercial items prepared in accordance with the format in Federal Acquisition Regulation FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only quote request; quotes are being requested. This is being issued as a Request for Quote (RFQ) under GSA requirement number TSR2020003448. This requirement will be awarded using OPEN- MARKET procedures in accordance with FAR Subpart 12, the acquisition of commercial items in conjunction with the policies and procedures for solicitation, evaluation, and award as prescribed in FAR 13, Simplified Acquisition Procedures.

Offeror shall submit a quote response in accordance with the instructions set forth in this document. Offeror shall submit exceptions to any of the terms and conditions of this RFP along with their quote for the GSA Contracting Officer to review. Failure to submit any exceptions will be considered concurrence.

ISSUING OFFICE

This RFP is being issued by GSA, Federal Acquisition Service (FAS), Telecom Services Contract Operations Division 3 in Atlanta, GA on behalf of the Department of Homeland Security.

Any contractual and/or technical questions shall be submitted in writing via email to the below identified GSA representatives no later than the above specified RFP closing date and time.

Offeror shall not contact the client or any other GSA or any other Government employee(s) regarding this procurement, other than the individuals identified above, without the prior approval of Everlean Rutherford, GSA, Contracting Officer.

The only method by which any term of this RFP may be modified is by a formal amendment to the RFP generated by the issuing office. No other communications, whether oral or in writing, will modify or supersede the terms of this RFP.

SCOPE OF WORK

GSA requests a quote for services listed below in the Scope of Work is to Install and Extend One (1) PRI with One Hundred (100) DID numbers at the Department of Homeland Security (DHS), Immigrations and Customs Enforcement (ICE), located at 4715 West Junction Street, Springfield, MO 65802, extended to DHS ICE UCIS LAN Room, Room 113.

The contractor shall provide One (1) PRI at Department of Homeland Security (DHS), Immigrations and Customs Enforcement (ICE), located at 4715 West Junction Street, Springfield, MO 65802 extended to the ICE LAN Room, Room 113, and terminate the PRI on an RJ-48 jack. Numbers are to be non-listed and non-published, and suppress outgoing Automatic Number Identification. PRI parameters will be included on the PRI Questionnaire upon award and TOPS order issue.

It shall be the responsibility of the winning offeror to coordinate the PORT of any existing numbers with the existing vendor. It shall be the responsibility of the winning offeror to provide the blank “Letter of Authority” required to port the numbers that are to be used within 2 days of award to the ATM for completion. All equipment must be picked up within 30 days of disconnect order upon contract completion or it will be considered abandoned.

Providers must indicate in their response that the quoted items are listed in their “Intrastate Access Services Tariff” that is on file with the Nebraska Public Service Commission (NPSC). The Access Tariff must support that the contractor is approved to provide local exchange carrier services in the geographic area of this requirement.

The services specified in this RFQ must be provided on the contractor’s owned outside cable plant that is connected to their LEC switch.

The contractor and subcontractor must be able to obtain a National Agency Check (NAC) clearance by the contract start date in order to perform services. Not obtaining a NAC clearance by the contract start date will not be an acceptable delay.

PLACE OF DELIVERY

Services shall be performed at the following location:

4715 West Junction Street, Springfield, MO 65802

PERIOD OF PERFORMANCE

The period of performance for this requirement is from May 01, 2020 to May 31, 2023. The quote shall reflect pricing for 37 months.

BASIS OF AWARD

This procurement is being conducted in accordance with FAR Subpart 12. The Government will issue a contract to an offeror upon determining the quote is technically acceptable and the price is fair and reasonable. Technically acceptable, as defined in this RFP, is meeting the exact specifications, part numbers, and quantities for the requested telecommunications services. The offeror should submit their best terms and/or their most favored pricing in their initial offer.

QUOTE SUBMISSION

Quote shall be submitted via email to Contracts Specialist, Everlean Rutherford at everlean.rutherford@gsa.gov.

Offerors are reminded their SAM registration status must be “Active”, at the time their offer is submitted, to be considered for award (see 52.204-7). Offerors submitting a quote in response to this Solicitation shall complete electronic Annual Representations and Certifications in conjunction with required Entity registration in System for Award Management (SAM), accessed via System for Award Management. In addition, unless available via SAM, the Offeror is to include a completed copy of their Representations and Certifications as per the provision FAR 52.212-3, Offeror Representations and Certifications-Commercial Items.

Offeror shall submit a completed copy of the provision at DFAR 252.209-7999 – Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction under any Federal Law (Deviation 2012-O0004)(Jan 2012). See Attachment A for full provision.

Quote shall be valid for a minimum of 60 calendar days after submission. Each number shall be listed on the quote separately. All standard features, fees and surcharges shall be detailed on the quote. Quotes submitted without detailed submission of features will not be considered.

Evaluation and Source Selection Criteria:

The Government contemplates a single fixed-price award to be made to a single vendor, by selecting the responsible offeror whose evaluated technical specifications, past performance, and price that best satisfies the Government’s expressed requirements of this scope of work, with regard to the following evaluation factors:

a. Technical Specifications

b. Past Performance

c. Price The Government reserves the right to communicate with Offerors to clarify or resolve quotation issues. The Government also reserves the right to make an award decision based on the initial quotation. Therefore, offers should contain all of the aforementioned requested information and best prices should be submitted with this Request for Quote.

The technical specifications are the most important factor and are more important than past performance and price. Technical specifications and past performance combined are significantly more important than Price. This process permits best value among price and non-price factors and allows the Government to accept other than the lowest price offer. The perceived benefits of the higher priced best value offer shall merit the additional price. This may result in an award to a higher priced offeror where the Government reasonably determines that the technical superiority and/or past performance of the higher priced offeror outweighs the price difference.

Technical Evaluation The Government will evaluate for technical acceptability of the technical submission for each paragraph and subparagraph of this SOW. With respect to the non-price factors, an Offeror is solely responsible for furnishing in its quote adequate details to allow the Government to assess the acceptability of the offer; an Offeror’s failure to submit adequate details may result in the Government finding the quote technically unacceptable. The Government reserves the right to confer with Offerors to clarify or resolve quotation issues. The Government reserves the right to make an award decision based on the initial quotation. Therefore, offers should contain all of the aforementioned requested information and best prices should be submitted. If an offeror intends to subcontract out any portion of this requirement or installation they must indicate in their response the intended subcontractor and provide the subcontractor’s DUNS number. Offeror must state in the technical evaluation if they and any subcontractor has a NAC clearance or able to obtain one by the contract start date.

Past Performance Past performance will be evaluated as a predictor of the Offeror’s compliance with contract requirements and overall quality of performance. Past performance will be evaluated on the basis of information received by the Contracting Officer concerning the Offeror's performance on other contracts, including information not submitted by the Offeror. The Government shall determine the relevance of similar past performance information. Provide all relevant past performance information that is similar to the work being requested in this requirement. Contact information for past performance references is required. Offerors shall include three (3) references to support past performance information. Information should include name, phone number, title, contract or task number and period of performance.

Price Evaluation Offeror shall provide fixed prices that are fair and reasonable. The fixed prices shall be supported by data other than certified cost and the Cost Element Matrix for each price component of Offeror’s solution. Pricing shall be based on the contract period of performance and requirement. Pricing shall be inclusive of all taxes and fees. Quotes must be provided by the PRI BTN phone number and shall be itemized by features, taxes, fees and surcharges by individual number. Offeror cannot charge for 911. The Contracting Officer will decide whether prices for the requirements are fair and reasonable. Offeror’s will be valuated based upon fair and reasonable total fixed prices for the Government requirements over the performance period of the purchase order.

INVOICE PROCEDURES

To expedite the payment process the following instructions are included for invoicing processing. The following information SHALL be followed:

A. Vendor Portal Requirements (UFT)

i. The vendor shall send an email notification to the FSC Mailbox each month notifying that an invoice is available to be downloaded.

ii. The email notification shall contain an account number or other account identifier.

iii. The vendor portal shall be Google Chrome Compatible.

iv. The vendor portal shall have a way to download and save the invoice in PDF format.

v. The vendor portal needs to have a setting for paperless billing to turn off paper bills.

vi. If there are multiple accounts with the vendor, these accounts need to be loaded onto the portal under a single sign-on.

vii. Other technical requirements depending on functionality of the vendor portal.

B. Vendor Email Invoice Requirements

i. The vendor shall send an email to the FSC Mailbox with the invoice attached in Excel and or PDF format.

ii. The attachment shall contain an account number or other account identifier.

PAST PERFORMANCE INFORMATION

The Government will provide and record Past Performance Information for acquisitions utilizing the Contractor Performance Assessment Reporting System (CPARS). The CPARS process allows Contractors to view and comment on the Government's evaluation of the Contractor's performance before it is finalized. Once the Contractor’s past performance evaluation is finalized in CPARS it will be transmitted into the Past Performance Information Retrieval System (PPIRS). Contractor’s are required to register in the CPARS, so Contractor’s may review and comment on past performance reports submitted through the CPARS. The CPARS and PPIRS websites are as follows:

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

As prescribed in 4.2105(a), insert the following provision:

Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (DEC 2019)

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.

(a) Definitions. As used in this provision—

Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer—

(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);

(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(End of provision) 52.204-25 Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment (Aug 2019)

(a) Definitions. As used in this clause—

Covered foreign country means The People’s Republic of China.

Covered telecommunications equipment or services means-

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means-

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled— (i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or (ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in Federal Acquisition Regulation 4.2104.

(c) Exceptions. This clause does not prohibit contractors from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement.

(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:

(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

(1) All covered telecommunications equipment and services offered or provided (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);

(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
