DEPARTMENT OF THE TREASURY
LIMITED-SOURCES JUSTIFICATION
This acquisition is conducted under the authority of the Multiple Award Schedule Program (see FAR 8.401)
Treasury Standard Form – 1012 (Rev 5/18)
Prescribed by Treasury: DTAP 1008.405-6 requirements in those areas, evidenced by numerous complaints from users to the COR and program office identifying intermittent service problems. Degraded service experienced by users is unacceptable considering the nature of the work; it is essential personnel have reliable wireless service in order to communicate efficiently with taxpayers, customers, and managers using both voice and data services in all locations where they work or travel.
Service coverage tests were then performed to validate complaints from users and the findings supported the complaints. In addition, AT&T formally dropped coverage in Puerto Rico because of reduced network capabilities.
From individual discussions with each of the BPA holders and the program office, Verizon was identified as the only company capable of providing the necessary level of service in the above named locations. This was a conclusive result over the five year life of the previous BPA, and is why Verizon continues to support of the total IRS LOS. In addition, the predecessor order for the LOS was competitively awarded to Verizon (TIRNO-16-Z-0010-0010 awarded in 2016) and there have been no changes to other vendor coverage areas (as evidenced in the quotes submitted in response to the new BPA solicitation).
The base period of this new order will continue to provide service for existing LOS supported by Verizon. The options periods incorporate a pro-rated increase (at the same ratio as what is currently received) expected from the legislation in process to increase funding and personnel numbers across Treasury for tax compliance. While it is not known if and when the legislation will be passed, Treasury is accommodating the possible increases in their procurement planning to ensure the resources and tools are quickly accessible when needed.
The government is aware of potential changes in offerings of the BPA vendors in the near term, and is the reason this order will be established with a base period and two option periods versus the traditional 12 month base and four one year options. While the order is in place, the program office intends to compete the order and take advantage of other vendor offerings, if available, to reduce their reliance on Verizon for services in the areas noted.
5. A determination by the ordering activity Contracting Officer that the order or BPA represents the best value consistent with FAR 8.404(d): The order will be placed using the competitively established BPA awarded on 18 August 2021. The prices offered by Verizon were determined to be fair and reasonable at the time of BPA award; however, further discounts will be requested due to the size of the order. As the BPA is newly established with the latest terms and conditions and pricing, the contracting officer has determined using this vehicle to make an award to Verizon will represent the best value to the government consistent with FAR 8.404(d).
6. A description of the market research conducted among schedule holders and the results or a statement why market research was not conducted: This requirement was competed and sourced through other vendors under the previous multiple-award BPA (T-Mobile, AT&T, and Verizon are the BPA holders); however, in execution only Verizon was able to consistently and reliably provide service in the areas noted above. The previous BPA and the newly awarded BPA are Treasury mandatory sources for obtaining telecommunications support. As this is vehicle is a mandatory source, no other market research was conducted.
7.a Any other facts supporting this justification: N/A
7.b Attachments: Yes No
8. A statement of the actions, if any, the Requiring Activity and Contracting Activity may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for the supplies and services is made: The program office is aware of potential changes in offerings of the BPA vendors in the near term, and is the reason the order will be established with a base period and two option periods versus the traditional 12 month base and four one year options. While the order is in place, the program office intends to compete the order and take advantage of other vendor offerings to reduce the reliance on Verizon for services in the areas noted.
