1. Description of Services: The contractor shall perform all required services and maintain all vehicles in accordance with this Statement of Work (SOW) and in compliance with commercial standards, local, state, and federal law requirements. The contractor shall provide bus and coach charter services for United States Air Force Academy requirements as defined and requested by Ground Transportation.
2. Safety: The contractor shall conform to the Regulatory Guidance for the Federal Motor Carrier Safety Regulations (www.fmsca.dot.gov), state, local and Title 49 of the U.S. Code of Federal Regulations (CFR).
Contractor shall at all times comply with all Occupational Safety and Health administration (OSHA) regulations applicable to the contractor's business, and any other Federal, State, and local regulations or laws related to the safety of the contractor's employees and the equipment and vehicles to be used by the Government.
a. It is the responsibility of the contractor to ensure orderly conduct of the passengers and perform all duties necessary to promote the welfare and safety of passengers.
b. In the instance of minor infractions of discipline (profanity, standing while the bus is in motion, extending arms out of windows, etc.) the bus driver shall report the infraction to 10 LRS Ground Transportation Operations Center at the earlies possible time.
c. Legal infractions shall be reported to the nearest appropriate law enforcement authority.
3. Scheduling and Cancellation.
a. The 10th Air Base Wing Contracting Office shall provide the contractor with an authorized caller list. This is a list of personnel who are authorized to request services under this Blanket Purchase Agreement.
b. Charter company cancellation policies may be less limiting to the Government, but not more restrictive than below. Contracts that are more restrictive for the government will not be signed.
c. The government may cancel charter services outside of 48 hours from the contracted requirement without penalty.
d. If the government cancels charter services between 48 hours and 24 hours from the requirement, a cancellation fee equivalent to 10% of the quoted price shall be paid to the contractor.
e. If the government cancels charter services inside of 24 hours from the requirement, a cancellation fee equivalent to 20% of the quoted price shall be paid to the contractor.
4. Vehicle Standards: All contractors' vehicles shall be mechanically maintained in a safe, usable and cosmetically acceptable condition.
a. The contractor shall furnish all fuel, oil and lubricants required for performance of the contract.
b. All systems must operate and function properly; the engine should operate smoothly and produce adequate power, and must meet current emission guidelines.
c. All maintenance and repair is the sole responsibility of the contractor and shall be performed off base (the operator daily safety and maintenance checks may be performed in the designated on-base parking area). In the case of conflict between applicable state and local regulations and the contents of this SOW, the contractor shall be required to meet the applicable state and local standards.
d. The government reserves the right to periodically inspect the contractor's vehicles, if any vehicle is determined to be unsafe or unsatisfactory, its use will be prohibited until such unsafe or unsatisfactory conditions have been corrected. In such event, the contractor must provide a replacement vehicle to ensure adherence to the schedule.
5. Vehicle Operations: Vehicles shall be operated in a safe manner and obey all posted speed limits.
Contracted drivers will follow the direction of base security forces and Ground Transportation.
a. Contractor personnel shall have current and valid professional/state bus driving certifications. The contractor shall ensure all bus drivers meet local license requirements; the license shall be in the possession of the bus driver when operating a bus under this contract. Licenses shall be available for inspection by Security Forces upon request. The contractor shall keep a copy of employee's certifications in their employee file and provide the Contracting Officer with a copy of all certifications if requested.
b. Drivers at no time shall discharge passengers upon public streets or cross roads; only at designated bus stops and when the bus has been brought to a complete stop at the shoulder/curb. Adequate safety precautions shall be taken while passengers are boarding or departing the bus. The driver shall not permit any illegal or unsafe practice. Upon notification from the Contracting Officer (CO), the contractor shall replace any driver who operates a vehicle in an unsafe manner, as determined by the government.
c. Contractor's drivers shall not use cell phones, eat food or drink beverages while operating a vehicle under this contract.
d. All contractors’ vehicles may be searched before entry to the base and/or cadet area. Drivers will be asked to exit the vehicle and open all compartments on the vehicle. The vehicle will then be searched by either Military Working Dog, detector, or visually. Once the search is complete, a pass will be issued to the vehicle for access to the cadet area.
e. Contractors are required to be in-place 30 minutes prior to the scheduled departure.
f. Pick-up and drop-off locations will be defined by the requestor. Common locations include: USAFA Core Values Ramp (CVR), Mitchell Hall Loading Dock (MHLD), Cadet Chapel, Arnold Hall, Cadet Issue, South Side Field House (SSFH), East Side Field House (ESFH), USAFA Varsity Baseball Fields, Prep School, Jacks Valley Training Area, 94th FTS, 98th FTS, 557th FTS, Stillman Field, Pike’s Peak or Bust Rodeo, iFLY Denver (Lonetree, CO), Schriever and Peterson AFB, CU Boulder, CSU Fort Collins, University of Colorado, Colorado Springs, Colorado College, Denver University, The Penrose House, Local Hotels, 10th Medical Group, Colorado Springs Airport, Colorado Springs Jet Center, Peterson SFB flight line, Denver International Airport (DIA), etc.
g. Day Trips and Temporary Duty requirements may include overnight trips to locations within Colorado, Wyoming, New Mexico, Kansas, Nebraska, Nevada, Texas, Arizona and other destinations as required.
h. Contractor will provide government requestor with an after-hours phone number to coordinate any changes/ issues with the contractor. Contractor will ensure this number is answered promptly (or call is returned within 15 minutes) during contractor office closure.
i. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services, equipment and vehicles.
j. The contractor shall obtain and maintain insurance coverage, including liability insurance, for each vehicle used to perform the requirements of this SOW, as required by the State of Colorado for the duration of this contract.
6. General Information
a. Government Remedies. Remedies against the contractor shall be in accordance with the contract, including its clauses and other applicable sections.
b. The contractor shall comply with Federal Acquisition Regulations (FAR) Procurement Integrity, outlined in FAR Part 3.
c. The contractor shall ensure that all items of possible personal or monetary value found by the contractor’s employees are turned in to 10 LRS Ground Transportation (Building 8122).
d. The contractor shall report to Security Forces and document all damage to property, either contractor or government, which the contractor has use of.
e. The contractor shall be responsible for reporting any missing items, parts and equipment, from their vehicles and shall notify the to 10 LRS Ground Transportation Operations Center within 24 hours of the completion of the mission.
f. Passengers may include Active Duty Military, Cadets, Cadet Candidates, Government Civilians, Distinguished Visitors, and Private Civilians/ Invited Guests.
