Justification and Approval for Other than Full and Open Competition Sole Source Acquisition

FAR Subpart 6.3 Other Than Full and Open Competition

Identification of the agency and contracting activity: Defense Health Agency (DHA), Directorate of Procurement (DoP), Contract Operations Division – Falls Church (COD-FC), VA 22044.

Nature and/or Description of Action being approved: Approval is being requested for a new firm fixed price contract using FY16 O&M funds for a 12-month base with four one-year option periods. Sole source acquisition will be conducted on other than full and open competitive basis with EBSCO Information Systems, 10 Estes Street, P.O. Box 682, Ipswich, MA 01938. The requirement is a sole source specific to EBSCO’s Cumulative Index to Nursing and Allied Health Literature Plus (CINAHL Plus) with Full Text Database Subscription with continuing education support. CINAHL Plus with Full Text is being requested to support Department of Defense (DoD), Military Health System (MHS) Wide healthcare system and all associated military medicine personnel and other DoD Health professionals regardless of duty location or organization including the component specified organization.

Description of Supplies/Services: The anticipated award date of 30 December 2015 with residual maintenance and training throughout the contract’s lifecycle. The DoD has a requirement for an online electronic subscription to the Cumulative Index to Nursing and Allied Health Literature Plus (CINAHL Plus) with Full Text Database. The requirement is sole source specific to EBSCO.

Statutory Authority Cited: The statutory authority permitting other than full and open competition is 10 USC 253(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

Reason for Authority Cited: EBSCO Health, EBSCO Nursing Resources information product CINAHL Plus with Full Text®.is the only product that supports the ongoing DOD evidence, based medicine requirements for the Nursing community with continuing education support.

The electronic version of the CINAHL Plus with Full Text database is a proprietary product that is developed, published, marketed, and distributed by EBSCO Information Systems. No other vendor sells electronic access to this product. The CINAHL Plus with Full Text database provides searching of bibliographic records for indexed articles, as well as links from the citations to the full text articles for more than 730 journals, including 278 journals where the full text articles are not duplicated in any other database products. Full-text coverage dating back to 1937, Indexing support for more than 5,000 journals and nearly 4.7 million records with searchable cited references for more than 1,400 journals CINAHL Plus with Full Text is the ongoing selected standard for online medical reference by both the Army and Air Force medical library communities. They have purchased subscriptions to supply their healthcare providers with access to this database. Continuation of the license for all of DoD’s healthcare providers will ensure that providers have the same access to a highly requested reference product as their Army and Air Force counterparts. It will also ensure the necessary standardization of online reference materials in the current tri-service medical environment.

No other vendors are authorized to resell electronic access to all of the product contents required by the government. The requirement is a core set of specialty nursing related comprehensive research database provides full text for nursing and allied health journals with evidence-based care sheets and quick lessons which provide concise overviews of diseases and conditions and outline the most effective treatment options. Content includes publications from the National League for Nursing, and the American Nurses' Association. There is no embargo on many of the most-used full-text journals contained in CINAHL Plus with Full Text. In addition, this database offers access to health care books, nursing dissertations, selected conference proceedings, standards of practice, audiovisuals, book chapters and more.

6. Efforts to Obtain Competition: As prescribed in DFARS PGI 206.302 it is required to Post a Request for Information or Sources Sought or obtain a waiver from the Head Contracting Agency (HCA). HCA has granted a waiver from requirement. Waiver is sent as an attachment dated 21 Dec 2015.

Actions to Increase Competition: Future requirements will be synopsized in accordance FAR 5.203. If another potential source emerges, the government will assess whether competition for future requirements is feasible.

Market Research: Market research was conducted to determine whether there were other vendors that can provide the same online reference resources as EBSCO in a complete package none were identified beside EBSCO.
