About this file
This justification and approval document authorizes a sole source award of a firm-fixed-price contract to Marine Engineers' Beneficial Association Calhoun Engineering School for shipboard systems engineering and shipboard land warfare indoctrination courses. The Naval Sea Systems Command Reserve Component requires these three-week training programs for 24 Navy Reserve engineering duty officers annually to meet requirements outlined in Instruction 1001.3. The estimated total value is $360,000 to be funded by fiscal year 2021 operation and maintenance funds with options to extend performance through fiscal year 2025. The justification cites 10 U.S.C. 2304(c)(1) as the statutory authority, noting MEBA is the only responsible source that can satisfy the agency's requirement by providing the specialized training in accordance with the instruction's compressed time constraints for reserve component personnel. Market research found no other available offers that could meet all required training components within the necessary three-week period.

JUSTIFICATION AND APPROVAL
IN REPLY REFER TO
J&A No. 50,187 Ser 02/3135
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.
2. Description of the Action Being Approved
This Justification and Approval (J&A) authorizes the award of a Firm-Fixed-Price, Contract on a sole source basis for the procurement of designing, developing, and providing Shipboard Systems Engineering and Shipboard Land Warfare Indoctrination Course (SSE/SLIC) in support of NAVSEA Command Reserve Component to Marine Engineers Beneficial’s Association (MEBA) Calhoun Engineering School, 27050 St Michaels Rd, Easton, MD 21601.
This J&A shall be effective from the date of approval to the end of the contract term.
3. Description of Supplies/Services
Naval Sea Systems Command Reserve Component Direct Commission Engineering Duty Officers (EDO) has a requirement to provide a three (3) week training program to 24 Navy Reserve Engineering Duty Officers(NREDs) each fiscal year covering SSE/SLIC requirements per NAVSEAINST 1001.3 Series.
The Government has identified the following courses as shown below:
Description of Courses Base OY(s) Shipboard Systems Engineering 1 Lot 4 Lot Shipboard Land Warfare Indoctrination 1 Lot 4 Lot
This J&A has a total estimated value of $360,000.00. This requirement will be funded with Operation and Maintenance (O&M) Funding for Fiscal Year (FY) 2021 with possible options that extend the period of performance until FY 2025.
Appropriation – O&M Funding
FY21 FY22 FY23 FY24 FY25 Total $72,000 $72,000 $72,000 $72,000 $72,000 $360,000
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.
5. Rationale Justifying Use of Cited Statutory Authority
In January 1989, the Chief of Naval Operations (CNO) designated Commander, Naval Sea Systems Command (COMNAVSEA), as the single designator advisor for the Engineering Duty Officer Community, including all NREDs. The EDO Community is comprised of highly educated Reserve Restricted Line Officers particularly trained to address complex technical issues and provide direct support to the active duty engineering officer community. Many of the NREDs bring direct fleet experience, as well as work in engineering disciplines in either public or private sector engineering enterprises. Each officer either has obtained or must obtain an advanced degree in one of several approved technical specialties. Each NRED is assigned to a cohort of 24 officers and then primarily assigned to a Navy shipyard to become an essential contributor to the ship design, building and overhaul efforts at the shipyard.
Per NAVSEAINST 1001.3 Series, the Naval EDO Reserve Officer program uses a single, centralized training structure, The Navy Reserve Engineering Duty Officer Qualification Program (NREDQP).
The NREDQP is the NRED "apprentice" program and provides the training and development to be successful at the current assignment while preparing the NRED for the next assignment.
The SSE/SLIC courses being procured are part of the initial foundational training NREDs require prior to undertaking progressively more challenging and fleet essential assignments.
NREDs cannot advance in their training or assignments without first completing the foundational training provided by the SSE/SLIC. NREDs are required to accomplish this training and development within the constraints of limited Reserve Drill time and Annual Training days available, and typically work full-time civilian jobs in either public or private sector engineering enterprises. MEBA has been developing the specifically tailored SSE/SLIC courses utilized by NAVSEA for the past ten (10) years and has created a condensed, highly intensive three (3) week program that meets all of the time and coursework criteria.
The viability of utilizing the Fleet to obtain the necessary classes and experience for the NREDs was considered as an alternative. After careful review, it was determined that this action is currently prohibited as NREDs are not eligible to attend shipboard training per COMNAVSURFORINST 1412.1C.
Additional, market research was conducted to determine if other firms provided a commercially available SSE/SLIC program that is capable of meeting the Government’s requirement. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart revealed no sources for the requested courses. Additionally, other commercially available training facilities were evaluated. This included companies located in fleet concentration areas such as Norfolk and San Diego to include, Mid- Atlantic Maritime Academy, MITAGS, Chesapeake Marine Training, and Training Resources Maritime Institute.
While the other training facilities offered courses covering some of the requirements, none of the evaluated facilities offered all the required training components. Further, each course offering that was available would take multiple weeks longer and would be spread out over the course of an entire year. This outcome is unacceptable. As noted, Reservist training must be compressed into the limited 3-week period available annually for training, while remaining coherent, sequential, and logical. Conventional iterative training schedules extended over time are wholly inappropriate for Reserve Component training.
Therefore, based on the above, MEBA is the only source available that meets the requirement to provide the SSE/SLIC in accordance with NAVSEAINST 1001.3 as required.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A sources sought notice was synopsized through beta.sam.gov on 08 April 2020 to express the Government’s intent to sole source this requirement. No businesses responded or provided their capability statements.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased from the offeror in the past and cost/pricing information was received on those past procurements.
This information should be sufficient to support the fair and reasonable cost determination of this procurement.
8. Actions to Remove Barriers to Competition
For the reasons set forth on Paragraph 5, NAVSEA, Corona Division, Contracts Department, Code 02 has no plans at this time to compete future contracts for the types of items covered by this document. If another potential source emerges, Code 02 will assess whether competition for future requirement is feasible.
