JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare

Center, Corona Division (Corona Division), Contracts Department, Code 0221.

2. Description of the Action Being Approved

Award of a Firm-Fixed-Price (FFP) contract on a sole source basis for tuition allotments that supports twelve (12) United

States (U.S.) Naval Officers chosen by the NAVSEA Sponsored

Graduate Program (SGP) to attend Massachusetts Institute of

Technology (MIT) University. Authority to act under this

Justification and Approval (J&A) shall be effective from the date of approval to the end of the contract term. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.

3. Description of Supplies/Services

NAVSEA’s SGP is tasked with procuring tuition from MIT for twelve (12) U.S. Naval Engineering Duty Officers (NEDO). This requirement includes both normal classes during the spring, summer and fall semesters, as well as an MIT hosted Professional summer for second and third year students. This program is designed to meet the needs of the U.S. Navy officers enrolled in the Naval Construction and Engineering Program at MIT.

The various comprehensive disciplines unique to MIT include

Systems Engineering and Naval Ship Design, Selection and

Processing of Structural Materials, Special Projects in

Structural and Environmental Materials, Ship Structural Analysis and Design, Design Principles for Ocean Vehicles, Plates and

Shells, Acoustics and Sensing, Unmanned Autonomy, Maneuvering and Control or Surface and Underwater Vehicles, Projects in

Naval Ship Conversion Design, Projects in New Concept Naval Ship

Design, Shipbuilding Operations and Technology, Surface Ship

Combat System Design Integration, Submarine Combat Systems, Ship and Submarine Signatures, Submarine Concept Design, and Weapons

Effects and Ship/Submarine Survivability.

The total estimate value of this acquisition is $3,664,887.88 and will be funded with Fiscal Year 2021(FY21) Operation and

Maintenance Navy (OMN) funds for FY21 Tuition. The table below depicts the type of funding as well as the estimated amounts for

FY21 through FY24.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c)(1) Only one responsible source, and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The Naval Construction and Engineering course program is taught exclusively by MIT instructors. To date, there are no equivalent programs available in order to enhance competition.

The NEDO’s will receive and train on the various elements identified in paragraph 3. The purpose of this acquisition is to enhance unique construction and engineering concepts in order for the U.S. Navy to maintain maritime superiority.

Short term, the Navy’s future strength and ability would be greatly diminished as nine Navy EDO graduate students would be dis-enrolled from MIT causing impact to their career paths and the EDO community. Long Term, it would severely reduce the overall strength of the NAVSEA Acquisition and Program

Management field. Students are in a 3-year program, which funds three groups of four (4) per year, including four (4) first-year, four (4) second year and four (4) third-year students.

The third-year students graduate in the spring, while four (4) elizabeth.groncki Highlight elizabeth.groncki Highlight new students begin in the summer session. The lack of education would cause loss of twelve (12) high potential EDO’s and waste of over $2.0M of already spent tuition on current students.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

A Sources Sought Notice (SSN) was posted on the beta.sam.gov website on 27 January 2021 to express the Government’s intent for the purchase of tuition for twelve (12) FY21 MIT Graduate

Program Naval Officer/students per year for both the Fall and

Spring Terms in a 3-year Engineering Graduate program. The SSN closed on 30 January 2021 and zero (0) responses were received.

In accordance with FAR 12.603, a combined synopsis solicitation will be issued for this requirement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government for the supplies/services covered by this J&A will be fair and reasonable. Corona Division will utilize: price analysis; commercial price lists; historical costs; and cost estimating relationships from previous procurements to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Competition

Corona Division will continue to perform market research to identify capable sources for future requirements related to this effort and if another potential source emerges, Corona Division will assess whether full and open competition is feasible.
