About this file

This justification and approval document authorizes a sole source contract award to CACI Inc Federal for design, engineering, and installation services to add a node to an existing Nokia optical transport system supporting a Marine Corps training facility on Guam. The total value of the acquisition is $500,000 to be funded from Procurement, Marine Corps funds in fiscal year 2021. The services include procuring Nokia equipment compatible with existing nodes, installation, configuration, documentation edits, and logistics support. A sources sought notice closed on January 12, 2021 attracting one response deemed incapable of meeting requirements. The contracting officer determined costs to be fair and reasonable based on past procurements from this contractor for similar work. The justification cites minimal disruption to the critical network as the reason for restricting competition and sole sourcing to the original installer familiar with the system's architecture.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1) Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The OTS node being procured and installed is in support of Military Construction Project P-715 – Marine Corps Live Fire Training Range Complex. The OTS is required to deliver network services to the range. If MILCON P-715 was completed 2 years prior, the OTS procurement would have been included as part of the original contract of 17 nodes. It was not possible to obligate for a system that was dependent on a MILCON that was not obligated and awarded to design-build contractor.

NCTS system maintainers are relatively new to the operation of the OTS and training provided to them only focuses on the provisioning of circuits and not the incorporation of additional OTS nodes. No other entities, than the original installers that can provide a nodal insertion. The original installers are accustomed to complexity of the OTS architecture and are capable of inserting the node on a critical production system, while minimizing the operational availability of the system. The OTS is the medium that connects terrestrial DISA circuits from cable landing facilities to all military components on the island of Guam. It transports Enterprise- Land Mobile Radio system (E-LMR) services for all components and all NIPRNet, PSNet, and Navy Telephony services. OTS is configured in a fault tolerant architecture. To insert a node, it is to know and change the architecture configuration, potentially eliminating fault tolerance, given that the configuration is in flux. In the event that the overall OTS elizabeth.groncki Highlight elizabeth.groncki Highlight elizabeth.groncki Highlight

Ser 02/1618 system fails, all services without out-of-band and alternate transports will be unavailable. Administrative services for all military components (Andersen Air Force Base, Naval Base Guam, Marine Corps Activity Guam, and other agencies), will cease until the architecture configuration for the OTS is corrected. Cost in loss of productivity will be proportional to all personnel requiring ELMR and NIPRNet services to conduct business.

As of 2017, there are 7000 military just between Andersen Air Force Base and Naval Base Guam. Now with the new base (Marine Corps Base Camp Blaz) being built, and additional 4000 people will be there at end state. Making the assumption that 1/3 to 1/2 of the people are working at any given time on base, and average 100 dollars per hour for the people working (to include benefits and administrative cost per person), a one hour mistake configuring the backbone cost $350K, plus inefficiencies of starting and stopping once services are restored. This does not include the cost to mobilize people to manually secure critical facilities and manually operating entrance control points for the lack of Defense Biometric Identification System (DBIDS).

Currently, there is a project underway to install $162k worth of equipment for the P-715 MILCON plus $340K worth of planning, design, preconfiguring in the CONUS environment (simulating the system, applying security configurations), travel, install, and commissioning new node. This augments a $2.8 million dollar backbone system. In order to install the $2.8 million backbone system, NCTS and NIWC spend about $250k survey, documenting, augmenting and upgrading facilities to support a make-before-break approach at 17 nodes.

Trying to utilize another solution would result in interoperability issues that would severely limit and disrupt Naval operations and create additional costs that couldn’t be mitigated or recouped in a competitive environment.

OTS system owner highly requests RS13 should hire the same agency, CACI,that performed works for existing 17 nodes to do the work for P-715 OTS. This will minimize the technical risks from taking the island-wide live OTS network down during P-715 node insertion. The impact such events would severely disrupt C4/IT communication among our joint DOD services on Guam.

Offerors as Practicable

A Sources Sought Notice (SSN) was posted on the Contract Opportunities (beta.SAM) website, indicating the Government’s intent to sole source this requirement to CACI. The posting was issued on 5 January 2021 and closed on 12 January 2021. At the close of the SSN, one (1) response was received from Heffler Contracting Group (HCG). The customer advised that HGC specialized in Horizontal and Vertical Construction and their capability statement did not show the expertise to achieve the Governments objective. HGC shows no work or history matching the effort needed nor modifications or justifications on their approach to show they will meet the requirement. The government is asking for telecommunication engineers and technicians to augment an existing Nokia PSS DWDM system to provide the Marine Corps Live Fire Training Range Complex communication services.

Without telecommunications utility, the +$78 Million MILCON training complex becomes a campground, not meeting its operational training requirement. With all the above reasons, RS13 has clearly determined that HGC cannot perform the tasks.

The existing NOKIA system is the telecommunication backbone for all the US military, US Navy hospital and three letter agencies on the island under Joint Region Marianas (Naval Base Guam – NCTS).

It transports all the administrative (network, security and telephone) and tactical networks for all the U.S. Military components. In addition, HCG did not identify or show an understanding of similar projects or work history that matches this effort.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased from this offeror in the past and cost/pricing information was received on those past procurements.

This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Corona Division, Contracts Department, Code 02 has no plans at this time to compete

Ser 02/1618 future contracts for the types of items covered by this document.

If another potential source emerges, Code 02 will assess whether competition for future requirements is feasible.
