About this file

This justification and approval document authorizes the award of a firm-fixed-price contract to L3Harris Technologies for the procurement of telecommunications infrastructure operating materials and supplies in support of the Royal Saudi Air Force. The contract value is estimated at $674,822 and covers equipment such as operator interface units, radio interface units, communication server units, management server units, and associated software licenses. The supplies are required to design a radio communications system at King Abdul Aziz Base and Khurais Electronic Warfare Range in Saudi Arabia to support air-to-ground radio communications for the Royal Saudi Air Force F-15 fleet modernization program. The justification cites 10 U.S.C. 2304(c)(1) as the statutory authority for this other than full and open competition procurement on the basis that L3Harris is the only responsible source as its equipment is compatible with and can control the Royal Saudi Air Force's existing Harris Falcon III radio systems.

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department Code 0221.

2. Description of the Action Being Approved

This Justification and Approval (J&A) authorizes the award of a Firm-Fixed-Price, contract on a brand name basis for the procurement of telecommunications infrastructure operating materials and supplies (OM&S) in support of Royal Saudi Air Force (RSAF) to L3Harris Technologies. Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.

3. Description of Supplies/Services

The Range Systems Engineering, RS10, has a requirement to design a radio communications system for the RSAF at King Abdul Aziz Base, Air Warfare Center (AWC) in Saudi Arabia. This system will support the RSAF to provide an Air to Ground (ATG) radio communications system at AWC flank tower and Khurais Electronic Warfare Range (KEWR). In order to meet these requirements, RS10 requires L3HARRIS radio equipment listed below:

FAT Factory Acceptance Test 1 ONSITE Onsite Training 1

This J&A has a total estimated value of $674,822.00 for the quantities identified above. The type of fund associated with this requirement is Foreign Military Sales (FMS) for Fiscal Year

(FY) 2021.

Appropriation FY20 Total

FMS $674,822.00 $674,822.00

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with (IAW) 41 U.S.C. 1901.

5. Rationale Justifying Use of Cited Statutory Authority

The items described in Paragraph 3, above, must be compatible in all aspects (form, fit and function) with existing systems presently used by the RSAF in support of the F-15 Fleet Modernization Case. The RSAF uses the Harris Falcon III radio and the Harris Voice Communications System to support air to ground training operations between the AWC and KEWR, if other equipment other than the L3Harris equipment is used we would be unable to integrate them into the current system. As a result the system as a whole would be unusable, and a new system would need to be developed which would results in mission delays for at least two years in order to be fully developed and integrated. The above listed items are the only radio interface hardware that can be integrated with the existing system and provide full integration with the existing Harris Falcon III radio system with Havequick II.

In addition, this radio interface hardware is the only equipment that can control the current installed Harris Falcon III radios.

If other equipment other than the L3Harris equipment is used we would be unable to control the current radios. As a result, the system as a whole would be unusable, and a new system would need to be fully developed and integrated from scratch.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A Sources Sought Notice was posted on Beta Sam’s website on 8/4/2021 and closed on 8/7/21 to express the Government’s intent for the purchase of L3Harris telecommunications equipment. One

(1) business responded and provided their capability statements.

The capability statements was sent to Range Systems Department (RS) for technical evaluation. The (1) response was considered technically capable of providing the requested L3Harris telecommunications equipment. It was determined that this requirement can be set-aside for small business.

Market research was conducted to locate same or similar replacement equipment compatible with the existing equipment and requirements. No other brand could satisfy the unique requirements brought forth by mission requirements other than what is referenced above. Based on information gathered during our most recent visits, the RSAF and NSWC Corona Division determined that Harris radios are capable of meeting the following system requirements: the ability to access and control radio and telephony, using intuitive graphical user interface.

In accordance with FAR 12.603, a combined synopsis solicitation will be issued for this requirement.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists, to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, Corona Division Contracts Department has no plans at this time to compete future contracts for the types of supplies covered by this document.

If another potential source emerges, Corona Division Contracts Department will assess whether competition for future requirements is feasible.
