About this file
This document is a justification for other than full and open competition (J&A) for the acquisition of a pump unit from Circor Naval Solutions LLC. The J&A covers the purchase of one reciprocating pump unit with national stock number 4YX 4320-01-544-1906 from Circor Naval Solutions, the original equipment manufacturer and sole source of technical data. The Department of the Navy Naval Supply Systems Command issued solicitation number N0010420RFB51 for this sole source procurement, and subsequently awarded contract N0010420CF018 for an unknown amount to an unknown vendor on September 30, 2020. The J&A cites 10 USC 2304(C)(1) authority, noting that only Circor Naval Solutions can meet the Navy's requirements due to its ownership of necessary technical data and expertise in manufacturing this complex component for Ohio-class submarines.

It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.
This acquisition will be solicited to
CIRCOR NAVAL SOLUTIONS LLC (63857) The Ohio-class submarine is a complex system of intricate and integrated parts. The Ohio-class of boats is over 30 years-old. In addition, the components on the ship have all gone through extensive design and testing reviews in order to maintain technical requirements in addition to sound requirements as the Ohio-class is to operate at near no-noise settings. While another part from another vendor may satisfy function, it would require extensive testing and design review to see if the part would satisfy form and fit as the space for this component is designed specifically for the part supplied by Circor Naval Solutions. As these ships are in the late stage life cycle, the review is both time and cost prohibitive and the Government needs to move forward with the acquisition from Circor Naval Solutions.
15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement
The proposed contract action was synopsized on the government-wide point of entry on 03/18/2020 and as a result no responses were received.
Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows
Market Research was conducted in the following databases: ITIMP (Integrated Technical Item Management & Procurement) System, EB Single Parts Master, TDP Tool, CDMD-OA (Configuration Data Managers Database-Open Archives), CITIS (Contractor Integrated Technical Information System), NSEDR (Naval Ships Engineering Drawing Repository), EIS (Engineering Information System), E-LAR's (Engineering Liaison Action System), LAR's, ERP/ORACLE/FMT, and FLIS.
The Government failed to procure adequate technical data necessary for these complex items which must meet operational and reliability requirements. CIRCOR NAVAL SOLUTIONS LLC (63857) possesses the necessary data rights to provide the required level of performance needed to meet fleet requirements.
The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also, future requirements will be advertised on the government-wide point of entry. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
