SINGLE SOURCE JUSTIFICATION FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

1. In accordance with Federal Acquisition Regulation 13.106-1, I hereby determine that the window replacement services appearing on purchase order 47PF0021P0017 is reasonably available from only one source, and competition is precluded for the reasons indicated below.

There are no substitutes available. Services are to be performed at the Patrick V. McNamara (PVM) Federal Building, 477 Michigan Ave, Detroit, MI 48266.

2. This acquisition is restricted to the following source:

KCorp support Services, Inc. (KCorp) 1603 College Rd.

Fairbanks, AK 99709-4175

3. This action will require KCorp to provide the necessary labor and equipment required to repair and replace three damaged windows. The windows are in four separate locations on the first floor at various heights. The services are estimated to cost $95,255.56 and will require an eight-to-ten week lead time for manufacturing and delivery.

Window dimensions and descriptions are provided, with an 11/16” insulated glass in existing spider fittings and an interior lite with a 7 mil clear blast film.

1 72” x 108” 3/8” tempered glass with Low E coating; stainless steel black airspacer

2 60” x 120” 3/8” tempered optiwhite glass .090 interlayer

3 60” x 98” 3/8” tempered optiwhite glass

4. The windows that require replacement and repair were damaged as a result of local civil unrest (protest) in Detroit.

The fabrications of these windows are very unique, consisting of two panes that are different thicknesses on the inside and outside. All four corners have holes that were cut into them during the manufacturing processes at 100% heat. These holes are for the mounting of the windows and must be exact in order to match the mounting hardware. The company that originally made the windows 12 years ago no longer manufactures the color (glazing) nor performs the process for cutting the holes into the windows. This work will also require use of a crane to hoist the windows (over 1,000 pounds each) into place. No other sources were located within the state that could match the glazing, recreate the holes in the window, and perform the install.

Due to the unique nature and specific characteristics of the windows and installation, only one source will be solicited. KCorp is currently under contract for operations and maintenance services at this location via GS05P16PSAD7001. The contractor has located

DocuSign Envelope ID: 2B8FA86A-B425-4DC3-9034-E85803AF5482 and recruited a local business that is able to obtain and install the replacement windows and will perform project management over this project. Only this suggested source can furnish the requirements, to the exclusion of other sources.

5. The material and service must be compatible in all aspects (form, fit, and function) with existing windows in the building and the aesthetic. The Government has verified that the proposed windows will be a close match and not deter from the physical appearance of the facility.

I certify that the information provided above is complete and correct to the best of my knowledge. In accordance with FAR 13.106-1, the facts of this acquisition preclude the use of full and open competition.
