JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
BRAND NAME JUSTIFICATION
This justification is prepared in accordance with the requirements set forth in 6.303-2(b).
1. Identification of the agency and contracting activity:

2. Nature and/or description of the action being approved.
NOAA intends to award a new purchase order to an authorized Gigamon reseller for maintenance on the current Gigamon Gigavue network switches for a period of 12 months. Two additional maintenance option years are also included in the purchase.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The Gigamon Gigavue network switches provide packet distribution capabilities to support the mission of the NOAA Coastal Services Center (NCSC) and are used for the Trusted Internet Connection Access Providers (TICAP) infrastructure. The requirement

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 – Only one Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the use of the authority cited.
Only Gigamon resellers are authorized to complete maintenance on any Gigamon products/equipment.
Allowing an unauthorized service provider to perform maintenance would void any warranties on the current Gigamon products/equipment.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice will be publicized as required by subpart 5.1, and, if not, which exception under 5.202 applies.
This requirement is being posted via Federal Business Opportunities as a combined synopsis/solicitation to solicit quotes from as many sources as practicable. Gigamon has confirmed that they have several small business resellers available that can submit quotes for the requirement.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
It is anticipated that adequate price competition will be received in order to determine that the order represents the best value. There is one small business vendor available on the GSA Schedules that provides Gigamon products. Their schedule can be used as reference when determining if the prices received in quotes are fair and reasonable. Historical information is also available for the types of services required that will be used for reference.
8. A description of the market research conducted and the results or a statement of the reason market research was not conducted.
Please refer to the attached market research memorandum for a summary of the market research conducted by the acquisition office.
Based on the market research conducted, it has been determined that the best method of procuring the products and services it to solicit authorized Gigamon small business resellers on the open market.
9. Any other facts supporting the justification.
The Gigamon Gigavue network switches are currently being used by the N-CIRT for packet processing activities. To keep this process uniformed across NOAA’s Enterprise Wide Network, hardware purchases for NOAA TICAP sites must be consistent and require yearly maintenance. Obtaining new hardware each year would require all users and administrators to be re-trained as well, thus switching to other network switches is not a possibility at this time. The burden of switching would be costly and not in the best interest of the agency. NOAA has invested over $200K on Gigamon hardware and training on its use. Utilization of another manufacturer’s hardware would render the current hardware useless and inoperable due to all switches needing to run concurrently and various brands are not compatible with one another. The costs associated with obtaining another manufacturer’s hardware and training are much greater than renewing the maintenance on the current Gigamon Gigavue network switches for a base and two option years.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
No sources have expressed an interest in the acquisition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
Prior to any subsequent acquisition, market research will be conducted to determine if Gigamon will allow other vendors authorization to work on their equipment. If this occurs, future acquisitions will be conducted to remove any barriers to competition. A review will also be conducted prior to the purchase of new hardware to determine whether there are multiple vendors available authorized to work on the equipment that won’t void any warranties.
