FEDERAL BUREAU OF INVESTIGATION

JUSTIFICATION FOR LIMITED

COMPETITION/SIMPLIFIED ACQUISITION

JUSTIFICATION AND APPROVAL FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

In accordance with Federal Acquisition Regulation 13.106-1 (b) (1), 1 hereby determine that the SkyHero Loki 2.0 listed on DJF-2-2200-PR-000XXXX is available from only one manufacturer (brand name only), and competition is precluded as there are no substitutes available.

1. This acquisition is restricted to the following sole source:

Company: Aardvark Tactical Company Address: La Verne, CA Company Point of Contact and Phone Number: Audrey Horstman, 909-451-6101

2. The SkyHero Loki 2.0 requirement for 29 Field Offices is estimated to cost $79,340.00 and is required to be delivered by 12/31/2 1.

The SkyHero Loki 2.0 is a small Unmanned Aircraft System (sUAS) intended for tactical use, most notably in indoor environments. The Loki 2.0 includes a Ground Control

System (GCS) to allow an individual to control the device without the need of a smartphone, tablet or electronic application, “App”.

3. Specific characteristics of the SkyHero Loki 2.0 that limit the availability to a sole source are listed below. Only this suggested source can furnish the requirements, to the exclusion of other sources, due to exclusive distribution agreement between SkyHero and Aardvark Tactical.

The Loki 2.0 is manufactured in a (Trade Agreement Act) TAA Compliant country, which is a requirement set forth by the contracting officer. No sUAS will be considered that is manufactured outside the USA and/or TAA compliant countries.

The Loki 2.0 meets sizing requirements by not exceeding 10”x 10”, with a diagonal distance of no more than 14”. As the standard residential door frame is 36”, these dimensions ensure a minimum 12” clearance on both sides of the sUAS.

The Loki 2.0 is capable of both indoor and outdoor flight. Position holding while indoors shall be accomplished without the use of GPS.

The Loki 2.0 meets the requirements of being rugged and durable, whereby the system will be operated in indoor environments, thus it must be able to sustain repeated bumps

into walls without breaking and/or crashing. Additionally, the Loki 2.0 can withstand being dropped from heights up to 4’ and continue to operate normally.

The Loki 2.0 command & control systems and image transfers must be AES256 encrypted .

The Loki 2.0 can be launched by being thrown in the air and stabilizing to a hover.

Market research has determined that the Loki 2.0 is the only tactical drone that “right itself ’ remotely should it become inverted. This process does NOT require the operator to physically move the sUAS, thus allowing the operator to remain distant from potential harmful environments.

The Loki 2.0 video transmission signal is analog, as opposed to digital. This ensures that there is no lag or frozen image transfers.

The on-board camera has both electro-optical and zero-light capabilities. Additionally, the camera has a viewing area of over 130'.

The Loki 2.0 GCS has the ability to operate four (4) sUAS’s.

The Loki 2.0 (ICS is compact and can be placed into pants pockets or mole pouches.

The GCS for the Loki 2.0 is built for use in the tactical environment, to include the ability to withstand dropping on hard surfaces.

The Loki 2.0 GCS is capable of operating the Loki 2.0 and (previously purchased) Loki 1.0, thereby limiting requirement to carry multiple GCS’s.

The Loki 2.0 exceeds the requirement of a flight time of 13 minutes and a camera viewing time of 180 minutes.

The Loki 2.0 has a one-piece, solid polycarbonate frame, which provides protection for the rotors. Add-on rotor guards would not provide sufficient protection within indoor envlronrnents.

4. Check and fill in all that are applicable for an Open Market Buy:

[X] The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is SkyHero Loki

1.0 and Loki 2.0 , and the new item/service must coordinate, connect, or interface with the existing system. The GCS for the new sUAS must have the ability to control/operate previously purchase sUAS’s.

El A patent, copyright, proprietary data, or licensing agreement limits competition. The proprietary data are described as follows:

SkyHero and Aardvark Tactical have agreed to exclusive distribution in the United States

[] These are "direct replacement" parts/components for existing equipment.

5. Any other facts supporting the limited source justification.

Contracting Officer requirement of TA A Compliant products.

Due to FBI security requirements, the sUAS may not be operated by an “app”.

The sUAS must have the ability to be launched by being throw into the air, and then stabilizing to a hover.

Sizing requirements are restricted to not exceed 10“x10” and cross length of 14” due to the primary use in indoor environments.

GCS must operate equipment applicable to this requirement and equipment previously purchased. This ensures operator familiarity.

The GCS cannot be cellular and/or WiFI dependent.

All technology utilized to enhance low-light environments must be built into the aircraft, and cannot be “strapped” onto the aircraft.

The sU AS must have a removable, rechargeable battery.

6. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

The Government will continue to research the market to obtain as many available sources as required in accordance with the FAR to ensure that there are other vendors out there that can satisfy this requirement. In addition, the customer will do due diligence in ensuring that barriers to competition are avoided to ensure we obtain the best value for the government.
