Sole Source Justification

1. Agency and Contracting Activity.

The Department of Homeland Security (DHS), U.S Citizenship and Immigration Services (USCIS), Office of Contracting (OCON), proposes to award a purchase order on behalf of the Office of the Chief Counsel (OCC).

2. Nature and/or description of the item/service being procured and anticipated cost.

DHS, USCIS, OCC, have prepared this justification for the procurement of annual Law360 Enterprise Plan Online Subscriptions, which is proprietary to Portfolio Media, Inc. (PMI), a wholly owned subsidiary of RELX, Inc., doing business as (DBA) LexisNexis, as an exception to fair opportunity. The Law360 Enterprise Plan Online Subscriptions include the following:

Coverage: Up-to-the-minute coverage on litigation, legislation, regulation, compliance, and enforcement, and deals that attorneys and business leaders need to know about to remain well versed in their practice areas and stay ahead of the curve.

Analysis: More than three (3) dozen senior reporters dedicated to research and analysis on current events, legal industry trends and other major topics.

Sections: Offers dozens of practice area, industry, and state sections — plus our ever-popular Business of Law content.

Business of Law: Provides news and analysis on important events related to law firms, corporate counsel, courts and judges, and other segments of the legal industry.

Rankings & Series: Our Glass Ceiling Report highlights efforts to bridge the gender gap in firm leadership, and individual attorneys vie for top honors in our annual MVP and Rising Star profiles.

Expert Analysis: Provide commentary from leading practitioners, in-house counsel, academics, and legal consultants across a range of legal issues — and give attorneys a way to showcase their expertise to peers and potential clients.

The content within the Law360 Enterprise Plan Online Subscriptions is in use by USCIS OCC attorneys, and the updates to these online subscriptions are necessary to stay current on legal issues. The Law360 Enterprise Plan Online Subscriptions cannot be obtained by any other vendor.

OCON intends to procure these Law360 Enterprise Plan Online Subscriptions from the following vendor:

The Independent Government Cost Estimate (IGCE) for this requirement is $ .

The delivery date for the Law360 Enterprise Plan Online Subscriptions is 07/18/2023. The subscriptions are provided for a total of twelve (12) months with a total potential period of performance of 07/18/2023 – 07/17/2024.

3. Identification of the authority and rationale.

The proposed procurement will utilize simplified acquisition procedures and will be awarded on a sole source basis in accordance with FAR 13.106-1(b)(1)(i) and as specified below.
