The proposed sole-source procurement has been announced to industry on the Acquisition Planning Forecast System: #F2021055005. In addition, a procurement pre-solicitation synopsis proposing a sole-source award to STE was advertised to industry on www.SAM.gov on August 19, 2021 (Notice ID 70RWMD21RFI00000009). No responses were received in reply to the notice.

7. Determination by the Contracting Officer (CO) that the Anticipated Cost to the

Government will be Fair and Reasonable

Pursuant to FAR 13.106-3(a)(2), the Contracting Officer will include a statement of price reasonableness in the contract file. Determination of price reasonableness will be based on any or a combination of the Market research, historical prices, and a comparison to the independent Government Estimate.

8. Description of Market Research

Market research was performed between May 2021 and September 2021 by researching backpack radiation detection system manufacturer websites for the required SLEP services as well as discussions with vendors and Government personnel. Though there are a few other manufacturers of backpack systems, it was determined that there are no other sources other than the RadPack OEM, STE, that would be able to provide the hardware and software that would function satisfactorily with the RadPack backpacks. No sources other than STE have been identified that are capable of providing the full range of repairs and common hardware and software configuration baseline work. Some sources such as radiation detection manufacturers Rapiscan Systems and Thermo Fisher Scientific may be able to perform small aspects of the total scope of activity that is required, however, these elements cannot be separated or completed independently of one another.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition

The SLEP award to STE is required to extend the service life of the RadPacks in order to preserve the ability of the U.S. Coast Guard (USCG) and Customs and Border Protection (CBP) to perform their radiation interdiction missions. If the contract is not awarded to STE for the SLEP, the Government would need to recapitalize its existing fleet of RadPacks with newer models at a much higher cost. It is estimated to cost to procure a new fleet of backpack radiation detection systems. Such procurement is not warranted at this time as the technical requirements of backpack systems have not changed. The estimated cost of the SLEP averages less than per device, representing a fraction of the cost of the procurement of new systems. Additionally, the extra time required for planning, procurement, testing, fielding and user training of new backpack devices would significantly impact component R/N interdiction missions. The planned RadPack SLEP represents the Government’s best option in terms of cost, schedule, and performance.

10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the

Acquisition

A procurement pre-solicitation synopsis was advertised to industry on www.SAM.gov on August 19, 2021 (Notice ID 70RWMD21RFI00000009) requesting that parties express their interest in this proposed sole-source procurement in writing to the CO. No responses were received by the closing date of the posting.

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome

Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required

It is anticipated that future requirements for new and replacement backpack radiation detection systems will be solicited competitively, thus eliminating barriers to competition.

12. DHS intends to post the requirement pursuant to FAR 13.501(a)(1)(iii).

13. Technical/Requirements Personnel Certification. I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
