SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS

From: Code, 635

To: Cognizant Code 02 Acquisition Branch

Subj: SOLE SOURCE JUSTIFICATION

1. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES, ESTIMATED VALUE, AND

DELIVERY REQUIREMENTS

NSWC Code 635 Expeditionary & Development Power and Energy (EDPE) seeks to procure a service and material contract capable of fabrication and delivery two (2) Lithium-ion Ultra- Lightweight Expeditionary Power System (U-LEPS) batteries for U.S Navy 9310 lithium battery safety evaluation. The estimated value of this material and service contract is with a delivery date of NLT: nine (9) months from award.

Manufacturer:

West Coast Solutions

2. SUPPORTING DOCUMENTATION FOR SOLE SOURCE BASED ON

CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION

Because of the proprietary nature of the U-LEPS battery, the manufacturer (West Coast Solutions) is the only source for acquisition. The U-LEPS was designed specifically for the USMC, and thus is the only battery, which will meet the requirement for the U.S Navy 9310 and code 635 testing. Failure to deliver the assets compromises NSWC’s ability to complete the tasking directed by the USMC U-LEPS Program.

Therefore, an award of any other battery would result in (a) substantial duplication of costs to the US Navy, which would not be recovered through competition, and (b) unacceptable delays in the completion of material selection efforts in support of the MCSC as previously stated. In accordance with FAR 13.106-1(b)((1)(i), the circumstances of this contract action deem only one source reasonably available.

3. MARKET SURVEY

Code 635 has performed a market survey for the U-LEPS battery. Because this is a proprietary battery designed specifically for the Marine Corps Systems Command under contract M6785420C6501 and U-LEPS system, West Coast Solutions is the only option for acquisition.
