Section A: General Contract Information
Contracting Activity: 341 CONS
Project/Program Name: Heat Plant Computer Upgrade

Section B: Description of the Supplies/Services Required
This requirement is for the procurement of the Bailey Heating Plant console and engineering station's operating system software and hardware upgrade, the required Security Workplace Maintenance Solution, along with a 36 month ABB software warranty.
Section C: Justification for Soliciting from a Single Source or Brand Name 10 U.S.C. 2304(c)(1), the property or services needed by the agency are available from only one responsible source or from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency, as implemented by FAR 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, required by FAR 6.303-2(b)(4).
(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in --
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or
(B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B).)
Section D: Efforts to Obtain Competition
As ABB, Inc. is the sole supplier for the Bailey INFI heating system which is currently utilized to operate Malmstrom AFB's heat plant, no other operating system will suffice for this requirement. As such, competition is not currently available for this requirement.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
Until ABB, Inc. teams with other potential offerors to allow the sale of its proprietary assets, there will be no availability to compete future similar awards precluding single source awards. Market conditions dictate availability of supplies and services, and presently, there is no expectation that market conditions may change.

Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
