SINGLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS ABOVE
THE MICRO-PURCHASE THRESHOLD AND UP TO SAT, INCLUDING BRAND NAME
J&A Number #21-0004
1. Agency and Contracting Activity.
The Immigration and Customs Enforcement (ICE), Office of Firearm and Tactical Program (OFTP), Office of Acquisition Management (OAQ), proposes to enter into a contract on a basis other than full and open competition (Brand Name).
2. Nature and/or description of the item/service being procured and anticipated cost.
(a) Type of action: Firm-Fixed-Price (FFP) Delivery Order (DO)
(b) Amount the current J&A is justifying: $99,995.00 (approx. $20,000.00 per unit)
(c) Brief Description:
The ICE OFTP Armory Staff have a requirement to procure five (5) Glare Helios Ocular Interruption devices used exclusively for law enforcement purposes, more specifically Maritime Interdiction Operations. ICE is seeking to purchase five (5) units for an approximate total cost of $99,995.00. The Item Number is #532-H1.
The Glare Helios Ocular Interruption Device is only available from one manufacturer, B.E.
Meyers & Co. Inc located at:

3. Sole Source Justification Rationale in accordance with FAR 13.106-1(b)(1)(i) and (ii).

Brand Name Rationale:
Due to the highly specialized law enforcement purpose (Maritime Interdiction Operations), only the Glare Helios Part Item #532-H1, manufactured by B.E. Myers, will satisfy ICE/OFTP’s needs based on the following:
Lightweight (15 ounces) and compact in size (5.5” L x 3.0 x 2.0) Item is immediate, directional, and provides an eye safe visual deterrent in excess of several thousand meters Ability to send an eye safe green beam which is clear and undeniable Ability to send a visual signal that is effective at extreme ranges and adverse conditions Item can be used in multiple configurations including hand-held, rail mounted, or integrated into other non-lethal systems including remote station operations Item has the optional feature of mounting a red dot optic for daytime aiming, as well as a shoulder stock mount for increased stability in rough conditions
To conclude, no other item besides the aforementioned Glare Helios device manufactured by B.E. Myers will satisfy OFTP’s immediate requirement.
4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)
☒ Market Research. Explanation- Through market research, ICE was able to locate several authorized re-sellers of the device on GSA Advantage offering competitive pricing. ICE previously purchased the same item in FY20 for $17,000/unit.

Efforts to Obtain Competition:
ICE plans to post the RFQ and Brand Name Justification (SSJ) on Beta.SAM.gov in hopes to receive competitive quotes. ICE was able to identify several authorized re-sellers on GSA Advantage that offered the exact product to meet OFTP’s needs as well as interest from the manufacturer in submitting a quotation.
