Section B: Description of the Supplies/Services Required

This is a commercial services acquisition. Contractor shall supply one (1) 70 Ton Chiller (nominal) to supply chilled water to 3 inch supply and return lines terminated outside of B640. Chiller unit shall supply at least 115 gpm at 60-70 water pressure. Rental is estimated to be a basic 12 months period of performance and 4 option years. Cooling load is 45 tons and may fluctuate. Chiller shall be able to operate at a partial load. Chiller unit shall operate at 480V-3Ph at 150 amps or less. Rental of this 70 Ton Chiller is temporary while a package is worked to purchase a chiller. This is an urgent requirement due to the two critical workloads that are served by this chiller. The two workloads support are the LANTIRN Laser/Transmitter Receiver and SNIPER AN/AAQ-33. The LANTIRN Cleanroom is the only facility in the world that still has the repair capability for the Laser Transmitter Receiver (LTR). The chiller unit keeps temperature and humidity within specifications so that the LTR can be repaired. If the chiller contract is not renewed there would be a work stoppage that will cost $100K revenue per month.

Section C: Justification for Soliciting from a Single Source or Brand Name

To change contractors at this point will cause duplication of effort and cost to the government that is not expected to be recovered through competition and will cause unacceptable delays critical to continued support of the 566th LANTIRN Clean Room Production line and SNIPER FMS work being performed in the clean room. Any delays will cause a work stoppage. Due to the vendor's existing on-site chiller operating at full functionality, the time it would take to procure, deliver, set-up and start-up would be too long. It is determined that only AmeriTemp can provide the services we require in a timely and cost efficient fashion without duplication of cost to the government. This is an urgent

Section D: Efforts to Obtain Competition

A search of the Dynamic Small Business Search (DSBS) database was conducted using NAICS codes 532412 (Construction, Mining, and Forestry Machinery and Equipment Rental and Leasing) and key word "chiller". A review of 8(a), HUBZone, Serviced Disabled Veteran-Owned, and Women-Owned small businesses was conducted in search of a company that could provide the required services for the 70 ton Chiller rental. A review of small businesses to include 8(a)- 2 vendors, HUBZone 0 vendors, Service Disabled Veteran Owned Business 0 vendors, and Women Owned Small Business (WOSB) - 1 vendor, was conducted in search of a company that could provide the 70 Ton Chiller Lease. See attached DSBS queries.

The 70 Ton Chiller Lease is considered a commercial service as defined in FAR 2.101. The lease of the 70 Ton Chiller is used by both the military and the commercial aviation industry.

GSA and mandatory sources have been reviewed but no sources identified.

In summary, only AmeriTemp Group can provide the rental of 70 Ton Chiller services required in a timely and cost efficient fashion without duplication to the government.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

In an effort to remove or overcome such a barrier to competition in the future, the market will be scanned frequently for new companies that could satisfy the government's requirements. Where possible, the government will prepare future requirement descriptions suitable for full and open competition.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
