About this file
This memorandum documents a justification for use of other than full and open competition for an acquisition under the simplified acquisition threshold. The requirement is for Eaton Corporation brand name Main Engine Clutch parts for the USNS HUMPHREYS (T-AO188) with an anticipated dollar value of $27,938.40. Only Eaton Corporation is identified as able to meet the requirement due to restrictive rights over the proprietary components which are critical ship equipment. The period of performance is from September 1, 2023 to December 4, 2023 with a required delivery date of August 1, 2023. The justification cites standardization initiatives and that the Military Sealift Command does not have the technical information required to determine equivalence for non-OEM parts.

I. BACKGROUND:
1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
