This Request for Proposal is for a requirements contract for the items and quantities listed herein. All clauses/provisions in this solicitation and resultant contract are important. Signing the face page of the solicitation acknowledges review and agreement of all clauses/provisions contained within.

This will be awarded using FAR Part 12 procedures. All responsible sources are permitted to compete.

The resultant contract will have one (1) 12month basic ordering period, and two (2) twelve month ordering periods.

Quantity: The quantities represented in the Schedule represent the Government's Best Estimated Quantities (BEQs) based on actual history and projected requirements. These BEQs do not represent a minimum or a maximum quantity. Failure of the Government to order the BEQ shall not entitle the contractor to an equitable adjustment in price under the contract.

Ordering Periods/BEQs are as follows:

Basic Ordering Period (Contract award through 12 months): 4 Each Ordering Period 1 (13 months through 24 months): 1 each Ordering Period 2 (25 months through 36 months): 1 each There are specific contractor fill-ins required in this solicitation. Please review carefully and complete all required fill-ins.

Note 1: In the event that only one offer is recieved, please be prepared to provide all necessary data to fully support your proposed prices, IAW FAR 215.371-3(b). The provided information should provide for a full analysis by the USG of the costs proposed for this effort.

Note 2: Please complete the attached Pricing Matrix, including unit prices and delivery.

Note 3: A subcontracting plan may be required and is requested to be included in proposal submission.

Note 4: Please submit proposal electronically to the Contract Specialist identified on the face page of this RFP by COB on (08/07/2023). Early submissions are accepted and preferred. A link to DoD SAFE will be provided if request is made to the Contract Specialist no later than COB (08/04/2023).

EVALUATION CRITERIA: The responsible offeror submitting the responsive proposal with the lowest Total Evaluated Price (TEP) will be the awardee. Total evaluated price will be determined by extending the unit price by the estimated total contract quantity for each ordering period. See Section J, Pricing Matrix, for further information.

(a) The Government requires delivery to be made according to the following schedule:

DELIVERY FOR EACH ITEM IS ANNOTATED IN THE SCHEDULE (PART I SECTION B) UNDER EACH LINE ITEM.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.

The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(a) At the conclusion of all applicable closeout requirements of Federal Acquisition Regulation 4.804, the Government and Contractor shall mutually agree on the residual dollar amount remaining on the contract. (a) Definitions. As used in this clause—

“Affected contractor” means a contractor that has incurred costs to provide paid leave for its employees or subcontractors to maintain its workforce in a ready state and otherwise meets all the requirements of section 3610 of the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) (Pub. L. 116–136).

(b) Reduction for credits or loan forgiveness.

(1) Section 3610 of the CARES Act requires that the maximum reimbursement to affected contractors authorized by section 3610 shall be reduced by the amount of any credits received pursuant to Division G of Public Law 116-127 and any applicable credits a contractor is allowed under the CARES Act. The Contracting Officer will reduce the amount of the funds authorized under section 3610 and provided by modification, commensurate with the amount of any credits or loan forgiveness received.

(2) Should the timing of any other reimbursements be such that the Contractor is unable to provide notification to the contracting officer prior to execution of a contract modification resulting from the Contractor’s section 3610 reimbursement request, the Contractor shall notify the contracting officer, as provided in paragraph (c), and agrees that the Government will modify the contract to reduce the reimbursed amount by the credit or loan forgiveness amount received.

(c) Notice of receipt of credits or loan forgiveness.

(1) The Contractor shall notify the Contracting Officer in writing within 30 days of receiving—
