II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm fixed price, fixed quantity, sole source contract. The contemplated contract will be with Safran Power USA (hereinafter Safran) Commercial and Government Entity (CAGE) code 3CPE0, for procurement of Generator Control Units to support the F-15E aircraft.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

Application: F-15E Aircraft Item Description and Function: 5.20 inches (width) X 7.365 inches (length) X 4.30 inches (height). Weight: 3.70 lbs. composed of Aluminum and corrosion resistant steel.

F15E Generator Control Unit (GCU) controls the electrical output of an AC generator.

Circuits within the GCU provide for electrical sensing, control logic, and protection.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. IAW FAR 6.304(a)(1), the approval level for this J&A is the contracting officer.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

Safran, as the designer and actual manufacturer of the item described in section III, is the only known source that has the necessary detailed manufacturing and process data (i.e.

production level data), parts, special tooling, and special test equipment needed to produce this part. Though the Government has limited form, fit, and function (FFF) data, this data is not sufficient to manufacture the item described in section III without an additional design engineering effort. The data required to competitively procure this item, without additional design engineering effort, from additional sources is production level data as specified in MIL-STD-31000. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data.

This item is a critical application item, as defined in the Aviation Critical Safety Item Management Handbook, on the F-15E electrical power system; as such it is a highly specialized component of a major weapon system. Development of additional sources to produce this part is not feasible within allowable timeframes. Delays in procurement have the potential of disrupting the availability of F-15E aircraft, thereby leaving the Air Force unable to meet critical mission requirements and hampering the Air Force’s ability to execute its global mission.

Drawing 51517-010B is not available in Air Force files. An attempt has been made to acquire the necessary data from Goodrich Corporation for competitive acquisition of this item. Goodrich Corporation, (now acquired by Safran) responded with a letter on 10- April-08 stating that data/data rights will not be provided to the Government.

Accordingly, Goodrich Corporation, (now acquired by Safran) is the only source capable of providing the requirement described in section III.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the Request for Proposal will be posted to the Federal Business Opportunities website. Government defined pre-award qualifications of new sources cannot be identified due to the unavailability of the necessary technical data as described in section V. The Original Equipment Manufacturer (OEM) is the only entity capable of approving additional sources at this time.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. If the proposal exceeds the Truth in Negotiations Act (TINA) threshold IAW FAR 15.403-4(a), the Contractor will be required to provide certified cost or pricing data. A detailed cost analysis and price analysis may be accomplished, as necessary. The Defense Contract Management Agency or Defense Contract Audit Agency may be contacted to assist with the analysis.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

Market research, in accordance with FAR 10, was conducted by a multi-functional team consisting of the Item Manager, Equipment Specialist, Logistics Officer, and Engineer.

This research included inquiries into internet sites including Google, the Thomas Register, Haystack, and similar item manufacturer’s websites and was conducted over a period ending 27-Sep-18. Other sources manufacture similar items but none have been identified as having access to the data described in section V necessary to meet the requirement described in section III. Further, this requirement cannot be modified nor be satisfied with a commercial or modified commercial item.

A Sources Sought Synopsis was also conducted during the market research effort described above to notify Safran licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website under 19-00572with a post date from 17-Sep-18 with a response date of 25-Sep-18. There were no responses received.

Based on this market research, Safran was found to be the only source able to fulfill the requirement described in section III.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Due to the lack of manufacturing data and qualification requirements, the Government does not expect that another source could become qualified in time to avoid unacceptable delay in meeting the Government’s requirement. Also, the Government does not consider this item a candidate for reverse engineering in accordance with DFAR PGI 217 Part 3- 303 screening procedures.

REQUIRED

The 422 SCMS will continue to monitor the marketplace for potential sources and will continue discussions with the OEM regarding additional sources. The Government will continue to synopsize requirements for potential sources, periodically screen the item for changes in data and source availability, and attempt to acquire the necessary data to competitively procure this item during future acquisition efforts.

XII. CONTRACTING OFFICER’S CERTIFICATION

By signing the coordination and approval document, the contracting officer determines this document to be accurate and complete to the best of the contracting officer’s knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
