NOTE: This is a SURPLUS ONLY requirement. Government or Commercial surplus in NEW/UNUSED condition or USED/OVERHAULED condition will be considered. It is the responsibility of each offeror to review the solicitation and comply with the surplus notes on page 7-11. Offerors must provide as part of their proposal ALL the required surplus documentation and fill out and return the Listing of Surplus Material.
The Government is considering the following categories of surplus:

PRICE COMPETITION NOTE: It is anticipated that pricing of this action will be based on adequate price competition; therefore, offerors will not be required to provide information necessary to determine price reasonableness. However, if after receipt of proposals it is determined that adequate price competition does not exist additional data may be required to determine price reasonableness.
The contractor shall submit quantity ranges that yield the best prices to the Government based on the quantity rage of 1 each to 8 each.

Government surplus or commercial surplus material as defined as (1) material, including commercial off-the shelf items manufactured for either Government or commercial use (e.g. production overrun quantities), which has never been sold to or accepted by the Government; or (2) material which would be considered “new Manufactured” except that it is not held by the actual manufacturer, the system contractor or subsidiary, successor, or distributor and as indicated below, will be considered to be acceptable in satisfaction of this requirement. New and unused material is acceptable provided it has never been installed or used. It shows no signs of rust, corrosion, or other deterioration due to age or improper packaging/preservation. Used and overhauled material is acceptable provided it is material, which has been previously installed in operational equipment. New and reconditioned means material not having been previously installed and not showing evidence of deterioration. Authorized part number is 301-334-417-0 (CAGE 58828) and no other part number is acceptable. OFFERORS MUST
ANNOTATE ALL PART NUMBERS BEING OFFERED.
Surplus material shall be new/unused material only. Acceptance inspection shall be conducted at origin facility by DCMA. Commercial off the shelf (COTS) surplus parts, supplied by surplus vendor shall have the original FAA Form 8130-3 or Certificate of Conformance with appropriate documentation annotated by the OEM’s manufacturing source. An incomplete, altered or incorrect FAA 8130-3 and/or Certificate of Conformance are unacceptable as an Airworthiness Release Record. Authorized manufacturer’s cage code and p/n are listed in Part Verification Section.
Surplus supply vendors are not part manufacturers, they are only supply vendors.
No commercially repaired, reconditioned or modified surplus COTS material will be authorized and/or acceptable for use in Military F108-CF-100 or F108-CF-201 engines. No FAA-PMA manufactured new/unused replacement parts that were approved for production under these methods, FAA designees, DER, DOA, DAS are allowed, unless specifically approved SAR package or 537ACSS Engineering approval prior to acceptance inspection. PMA P/N’s are identified with either prefix/suffix to differentiate from OEM P/N and are not acceptable without prior approval. ATA Spec 106 is not an FAA acceptable form for surplus material.

Requirements for Used/Overhauled Government or Commercial Surplus Material:

Authorized part number is 301-334-417-0 (CAGE 58828) and no other part numbers are acceptable. OFFERORS
MUST ANNOTATE ALL PART NUMBERS BEING OFFERED.
In order to be acceptable, all Used/Overhauled Government/Commercial Surplus shall be overhauled (repaired) IAW CFM Engine Shop Manual by the following sources Lockheed Martin CES (CAGE L06Y2), These sources are not contractually bound to provide services. Offeror shall provide evidence that the required overhaul work has been performed, or will be performed prior to shipment, as required. Offeror shall obtain the required evidence from Lockheed Martin CES and provide it with offeror’s proposal.
Offeror shall provide the following required documentation with their proposal or shall be deemed non-responsive:
1. The supplier must provide a cover letter including the method being used to purchase the CU&OH parts and all available traceability paperwork showing the OEM birth, and ownership history of the item.
2. Offeror will provide a statement of availability and support from the repair source. The repair source agreement must be for the above part number(s) and be with the approved repair source(s) listed above.
3. Offeror’s ISO 9001:2008 Certificate or AS9100
4. Offeror’s Certificate of Conformance (CoC), such as an ATA Specification 106 “Part or Material Certification Form” or similar form (with like information) containing a non-incident statement, certifying that the items were manufactured by the Original Equipment Manufacturer (OEM) annotated in this solicitation, and were not removed from engines that operate in volcanic ash, radiation exposure or submerged.
5. Offeror will provide a complete, original FAA Form 8130-3, issued by the USAF approved repair source at the time of part delivery.
An incomplete, altered or incorrect FAA 8130-3 and/or CoC are unacceptable. Commercially repaired or overhauled surplus items will be authorized and/or acceptable for use in Military F108-CF-100 or F108-CF-201 engines. No FAA-PMA manufactured new/unused replacement parts are acceptable. No FAA designees, DER, DOA, DAS are allowed.

SUBMERGED.

(a) Definitions. As used in this clause—
“DoD recognized unique identification equivalent” means a unique identification method that is in commercial use and has been recognized by DoD. All DoD recognized unique identification equivalents are listed at http://www.acq.osd.mil/dpap/pdi/uid/iuid/equivalents.html .

(d) Comptroller General Examination of Record. (a) Definitions. As used in this clause—
(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.
(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.
(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. (c) The Contractor may submit a payment request and receiving report using other than WAWF only when—
(1) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment;
(2) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System);
(3) DoD makes payment for rendered health care services using the TRICARE Encounter Data System (TEDS) as the electronic format; or

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.
The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) The Competition Advocate (CA) at each contracting activity/office (as defined in DLAD 2.101) shall act as the ombudsman and attempt to resolve contractor complaints. DLA Aviation at Oklahoma City-AOB’s CA/ombudsman can be reached at (405) 734-8241, facsimile (405) 734-8219. Complaints which cannot be so resolved shall be forwarded to the HQ through J-72 for resolution by the DLA competition advocate. Each activity is responsible for developing procedures for executing the duties and responsibilities of its local ombudsman.
(d) The ombudsman has no authority to render a decision that binds the agency.
(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements.
Such inquiries shall be directed to the Contracting Officer.

5352.223-9000 ELIMINATION OF USE OF CLASS I OZONE DEPLETING SUBSTANCES (ODSs)

(a) Contractors shall not:
(1) Provide any service or product with any specification, standard, drawing, or other document that requires the use of a Class I ODS in the test, operation, or maintenance of any system, subsystem, item, component, or process; or
(2) Provide any specification, standard, drawing, or other document that establishes a test, operation, or maintenance requirement that can only be met by use of a Class I ODS as part of this contract/order.
[NOTE: This prohibition does not apply to manufacturing.]
(b) For the purposes of Air Force policy, the following products that are pure (i.e., they meet the relevant product specification identified in AFI 32-7086) are Class I ODSs:
(1) Halons: 1011, 1202, 1211, 1301, and 2402;
(2) Chlorofluorocarbons (CFCs): CFC-11, CFC-12, CFC-13, CFC-111, CFC-112, CFC-113, CFC-114, CFC-115, CFC-211, CFC-212, CFC-213, CFC-214, CFC-215, CFC-216, and CFC-217, and the blends R-500, R-501, R-502, and R-503; and
(3) Carbon Tetrachloride, Methyl Chloroform, and Methyl Bromide.
