The use of authority 10 U.S.C. 2304(c)(1) is based on:
AMC 1. Suitable for competitive acquisition for the second or subsequent time.
AMC 2. Suitable for competitive acquisition for the first time.
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
AMC 4. Acquire, for the first time, directly from the manufacturer.
AMC 5. Acquire directly from the sole source contractor, who is not the manufacturer.
AMSC A. The Government’s right to use data in its possession is questionable. This code is under review and will be updated when the review is complete.
AMSC B. This must be acquired from a manufacturing source(s) specified on a source control drawing.

Drawing AY33112489-1CDF PL is proprietary. Data use rights are limited. In an attempt to acquire the data/data use rights to this item, the Government requested a corporate policy for the release of data from RSL on 11 Feb 11, 8 Dec 14, and 3 Mar 16. To date, there has been no response, which the Government has construed as a refusal to release data. This is a critical safety item. The Government has established Manufacturing Qualification Requirements (MQRs) for this item (MQR-1 Revision E, dated 14 Dec 11). Cage 0368A RSL is the only known source as of Jan 17; accordingly, RSL possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item.
The development of an additional source to produce this item is not feasible within allowable timeframes. Delays in new procurement have the potential of disrupting the availability of J85 engine, leaving the Air Force unable to meet critical mission requirements.
For these reasons, RSL is the only responsible source capable of providing the supplies described in Section III above without the Government experiencing unacceptable delays in fulfilling agency requirements and is the only responsible source capable of providing the items described in Section III.

The contracting officer will complete a price analysis. If the proposed dollar amount exceeds the TINA threshold IAW FAR 15.403-4 , certified cost or pricing data will be required and a detailed cost analysis will be accomplished.
Support from the Defense Contract Management Agency or the Defense Contract Audit Agency may be requested as appropriate to aid in evaluating the proposal.
Market research, in accordance with FAR Part 10 was conducted by Haystack, Parts Manufacturer Approvals, and a web search of Google and Thomas Register. The market research was accomplished on 27 Jan 17. This research revealed that there is not a commercial item available to meet this requirement. Further, this requirement cannot be modified and be satisfied with a commercial or modified commercial item. This is a non-developmental item.
Another amplifier exists, CAGE 89954, part number 101E9889G03 (NSN: 5996-01-476-9550 OK) that meets the same technical requirements. This alternate part has not been solicited since 2004 because previous solicitations have shown that its price is considerably higher than NSN: 5996-01-582-7251OK. Also, logistics support of this alternate repairable asset would require an additional, parallel, support chain.
A Sources Sought Synopsis was also conducted during the market research effort described above to notify RSL licensees, vendors, or other sources with access to the necessary data of pending acquisition. This posting was created on the Federal Business Opportunities website under the PR number FD2030-17-01136 on 13 Mar 17 with a response date of 20 Mar 17. No responses were received from this request.
Based on the above, a high level of confidence exists that RSL is currently the only responsible source able to fulfill the requirement.

Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
When FAR 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate if the cost to the Government that would be duplicated and how the estimate was derived.

Reverse engineering is not feasible as the QRs do not allow for a "Category III" (new item) capability.

The AFLCMC/LPSEC will continue to monitor the marketplace for potential sources. The Government will continue to synopsize requirements for potential sources, periodically screen the item for changes in data and source availability, and attempt to acquire the necessary data to competitively procure this item during future acquisition efforts.
