The use of authority 10 U.S.C. 2304(c)(1) is based on:
AMC 1. Suitable for competitive acquisition for the second or subsequent time.
AMC 2. Suitable for competitive acquisition for the first time.
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
AMC 4. Acquire, for the first time, directly from the manufacturer.
AMC 5. Acquire directly from the sole source contractor, who is not the manufacturer.
AMSC A. The Government’s right to use data in its possession is questionable. This code is under review and will be updated when the review is complete.
AMSC B. This must be acquired from a manufacturing source(s) specified on a source control drawing.
AMSC C. This part required engineering source approval by the design control activity in order to maintain the quality of the part.
AMSC D. The data needed to acquire this part is not economically available.

This part has been designated a high reliability part. Probability of failure would be unacceptable. The engineering activity has determined that data to define and control reliability limits cannot be obtained.
The design of this part is unstable. Engineering, manufacturing, or performance characteristics indicate that the required design objectives have not been achieved.
The Government does not possess the process data or the necessary resources to manufacture this part to fulfill customer requirements. This part is a commercial/ non developmental/off the shelf item. Currently, Woodward, Inc is the only known source for this item. This item is a highly specialized component of an engine assigned to a major weapon system; accordingly, Woodward, Inc possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item.
No other sources have been qualified for this item. Air Force does not possess engineering/drawing data or data rights to qualify an additional source. No qualification requirements can be stated or created for this item, as Air Force has no data available to create them. Woodward, Inc, the Original Equipment Manufacturer (OEM) for this item, has been contacted and will not give their technical manufacturing data to the Government.
Accordingly Woodward, Inc is the only responsible source capable of providing the items described in Section III above.

The contracting officer will complete a price analysis. In determining price reasonableness, the contracting officer may rely on information such as established catalog or market prices or, if necessary, information other than cost and pricing data from the potential source. The Defense Contract Management Agency (DCMA) may be contacted to assist with the price analysis, if necessary.
Market research, in accordance with FAR Part 10, was conducted including inquires of available Air Force data systems, such as Haystack, Parts Manufacturer Approvals, Google, and Thomas Register. This research revealed that Woodward is the only approved source for this part.
A Sources Sought Synopsis was also conducted during the market research effort to notify GE licensees, vendors, or other potential sources of this requirement. This posting was created on the FedBizOpps website on 5 Aug 16 under Purchase Request Number FD2030-17-00226 with a response date of 11 Aug 16. No interested sources submitted source approval packages to be considered.
Based on the above, a high level of confidence exists that Woodward is currently the only responsible source able to fulfill this requirement.

Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

The Government will continue to monitor the marketplace for source development. The Government will continue to synopsize the requirement, re-screen the item and attempt to acquire the data necessary to qualify additional sources.
