JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm-fixed price, multi-year contract. The contemplated contract will be with Triumph Thermal System Incorporated (Triumph), Commercial and Government Entity (CAGE) code 78943, for the manufacture of the lubricating coolers to support the F100 engine.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS

Item description and function: 15.37 inches long X 6.50 inches wide X 7.00 inches high, weighing 15 lbs., and composed of aluminum. This item cools the engine oil.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. IAW with FAR 6.304(a)(2) the approval level for this J&A is the Contracting Officer.
V. DEMONSTRATION THAT THE CONTRACTORS’ UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE
USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF
AUTHORITY)
Drawing 4065924 from the Original Equipment Manufacturer (OEM) for this item, Triumph, CAGE 78943, is a source control drawing as defined by the current version of DoD-STD-100. Suitable manufacturing and technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Triumph is the only source listed on the source control drawing, and is thus the only known source that can satisfy the Government’s requirement. This item is a highly specialized component of a major weapon system engine; accordingly, Triumph possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item.
The Government has contacted Triumph numerous times in hopes of obtaining access to source control for this item. Inquiries were made on 10 Oct 07, 17 Mar 11, and 26 Jan
15. To date, there have been no responses to any of these inquiries, which the Government has construed as a refusal to its requests. For this reason, the data use rights and acceptance test criteria needed to foster competition for production is not available to the Government presently, and it is not possible to draft adequate specifications. A substitute item may not be used without prior testing and approval by the OEM.
The development of an additional source to produce this item is not feasible within allowable timeframes. The Government anticipates a minimum of two years for the OEM to process and validate an alternate supplier’s approach. To the Government’s knowledge, the OEM has not received any requests to qualify additional sources for this item.
Accordingly, Triumph is the only source capable of providing the supplies described in paragraph III without the Government experiencing unacceptable delays in fulfilling agency requirements.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED
PRACTICABLE
In accordance with FAR 5.201, this requirement shall be synopsized and the Request for Proposal will be posted to the Federal Business Opportunities website. The Government does not have qualification requirements as only Triumph, approves additional sources.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide certified cost or pricing data. A detailed cost analysis and price analysis may be accomplished. The Defense Contracting Management Agency may be contacted to assist with the analysis.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH
WAS NOT CONDUCTED
As described in Section VI above, market research, in accordance with Far Part 10, was conducted 11 Aug 15 by market research of the proposed acquisition advising industry of the pending acquisition and soliciting inquiries from interested parties. This research revealed that there is not a commercial process available to meet this requirement.
A Sources Sought Synopsis was also conducted during the market research effort to notify Triumph Thermal licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website under the PR number with a response date of 4 Nov 15.
Based on this market research, Triumph Thermal was found to be the only source able to fulfill the requirement described in section III.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
Due to the fact that neither qualification testing of another part nor the use of a second source part in the intended application is permitted, reverse engineering efforts would not be considered economically feasible and schedule prohibitive for the Air Force. To date, no such efforts have been initiated or funded.

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES
REQUIRED
The Government will continue to monitor the marketplace for source development, and will continue discussions with the OEM regarding additional approved sources. The
Government will continue to synopsize the requirement, rescreen the item and attempt to acquire the data necessary to qualify additional sources.
XII. CONTRACTING OFFICER’S CERTIFICATION
By signing the coordination and approval document, the contracting officer determines this document to be accurate and complete to the best of the contracting officer’s knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the coordination and approval document, the technical or requirements personnel certify that any included, supporting data within their area of responsibility is both accurate and complete.
