The use of authority 10 U.S.C. 2304(c)(1) is based on:
AMC 1. Suitable for competitive acquisition for the second or subsequent time.
AMC 2. Suitable for competitive acquisition for the first time.
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
AMC 4. Acquire, for the first time, directly from the manufacturer.
AMC 5. Acquire directly from the sole source contractor, who is not the manufacturer.
AMSC A. The Government’s right to use data in its possession is questionable. This code is under review and will be updated when the review is complete.
AMSC B. This must be acquired from a manufacturing source(s) specified on a source control drawing.

Triumph Engine Control System, LLC is the only source for this item. This item is a highly specialized component of an engine assigned to a major weapon system; accordingly, the contractor listed possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item.
The development of an additional source to produce this item is not feasible within the allowable time frames.
Delays in new procurement have the potential of disrupting the availability of TF33 engines, leaving the Air Force unable to meet critical mission requirements.
Accordingly, Triumph Engine Control System, LLC is the only responsible source capable of providing the items listed in Item 3 above.

The solicitation was posted to FBO on 14 September 2016.
The contracting officer will complete a price analysis. If the item is of a type offered and sold competitively in substantial quantities in the commercial marketplace, thus considered commercial items, the contracting officer will determine in writing that the offeror has submitted sufficient information to evaluate, through price analysis, the reasonableness of the price. Support from the Defense Contract Management Agency or the Defense Contract Audit Agency may be requested as appropriate to aid in evaluating the proposal.
Market research, in accordance with FAR Part 10 was conducted by a multi-functional team. This research included inquiries into internet sites including Haystack, Parts Manufacturer Approvals, Google, Thomas Register, and similar item manufacturer’s websites and was conducted over a period ending 12-Nov-16. Other sources manufacture similar items but none have been identified as having access to the data described in section V necessary to meet the requirement described in section III. Other companies that perform similar efforts exist in the marketplace, but they do not possess the applicable data required to meet the Government’s specifications. As a Critical Safety Item, failure of this item during engine operation can result in loss or substantial to the weapon system, or death or serious injury to personnel. This is a non-developmental item and substitutes are not available.
A Sources Sought Synopsis was also conducted during the market research effort described above to notify Pratt & Whitney licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website on 04 November 2015, under the NSN and PR number with a response date of 12 Nov 2015 and no response was received.
Based on the above, a high level of confidence exists that Triumph Engine Control Systems is currently the only responsible source able to fulfill the requirement.

Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
When FAR 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate if the cost to the Government that would be duplicated and how the estimate was derived.

This item has been designated a Critical Safety Item. Because the risk associated with reverse engineering, including possible damage to engine or aircraft should this item fail during engine operation, outweighs any potential gain or cost savings, the Government considers this item too critical to make reverse engineering feasible.
