V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED

ABOVE (APPLICABILITY OF AUTHORITY)

The Government does not own the data or the rights to the data needed to purchase this part from additional sources. Woodward will not sell, loan, lease, or otherwise release to the Government the data or data use rights necessary for the manufacture of this item. Due to the unique nature of this data, competition is not anticipated during the life of this contract. This item is a highly specialized component of a major weapon system, as it controls electrohydraulic flow in the F-15 aircraft; accordingly, Woodward possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item.

The Government has made numerous attempts at obtaining from Woodward the data necessary for the manufacture of this item. Letters requesting a corporate policy for the release of data were issued on 5 Dec 05, 3 Apr 08, and 7 Oct 10. To date, Woodward Inc. has failed to respond to any of these letters, which the Government has construed as a refusal to release data. Due to the lack of data use rights, the data and acceptance test criteria needed to foster competition for production are not available to the Government, nor is it possible for the Government to draft adequate specifications.

423 SCMS believes that award to any other source would result in unacceptable delays in fulfilling the Air Force’s requirements. The development of an additional source to produce these items is not feasible within allowable timeframes. Delays in new procurement have the potential for disrupting availability of F-15 aircraft, leaving the Air Force unable to meet critical mission requirements.

Accordingly, Woodward is the only responsible source capable of providing the items described in Section III above.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED

FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposals posted on the Federal Business Opportunities website. Qualification requirements do not apply as only Woodward has access to the data.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide other than certified cost or pricing data. A detailed cost analysis and price analysis may be accomplished.

The Defense Contract Management Agency may be contacted to assist with the analysis.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS,

OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

Market research, in accordance with FAR Part 10, was conducted on 9 Sep 14 by inquiries of Parts Manufacturer Approvals, HAYSTACK, and web searches conducted on Google and ThomasNet.com, but all inquiries were unsuccessful in revealing any additional sources for this item. Commercial items suitable to meet the requirement are not available. The item described in Section III is used in military applications and no commercial or non-developmental substitutes are available.

Other companies that perform similar efforts exist in the marketplace, but they do not possess rights to the technical data available to Woodward, which is required to meet the Government’s specifications.

Based on the above, a high level of confidence exists that Woodward is currently the only responsible source able to fulfill the requirement.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

Due to the infrequent nature of the buy requirements, the Government considers reverse engineering economically unfeasible.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

The 423 SCMS engineering group will continue to monitor the marketplace for source development, and will continue discussions with Woodward regarding additional approved sources. The Government will continue to synopsize the requirement, rescreen the item, and attempt to acquire the data necessary to qualify additional sources.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that contracting officer has determined this document to be both accurate and complete to the best of contracting officer’s knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and requirements personnel have certified that any included, supporting data contained herein which is within their responsibility is both accurate and complete.
