It is the intention of DLA Aviation at Oklahoma City to allow a 45-Day Solicitation period for Northrop Grumman License Agreement applicable acquisitions with days 1 through 15 being allotted to allow time for additional potential sources to submit requests for, and receive, the NGLA Technical Data Package via DoD Safe.
This additional time over-and-above the standard 30-day Solicitation timeframe is a courtesy and serves as constructive notice that it is the affirmative responsibility of potential offerors to monitor the Sam.gov and quickly process requests for the NGLA Technical Data Package via Dod Safe and that Solicitation Closing Dates WILL NOT be extended for the sole-purpose to allow for additional time to propose.
Contract Type: The requirement is for a fixed quantity utilizing a Firm Fixed price contract vehicle.
Proposal Evaluation: See solicitation Sections L and M for instructions to offerors and proposal evaluation criteria.
Basis of Award: The acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR Part 15.101-2, as supplemented.

Price Competition: Competition may/may not be realized. However, if after receipt of proposals, competition does not exist, the PCO reserves the right to request and to receive cost and pricing information from the offeror in order to establish a fair and reasonable price. FAR Part 15 clearly reflects the rules and establishes appropriate guidance.
NOTES APPLICABLE TO FIRST ARTICLE 0001AA and 0001AB
There is a requirement for a First Article and First Article Test Report. After the First Article Test Report has been performed by the contractor for the two First Article units, in accordance with 52.209-3 (Contractor Test), the Test Report is to be sent to Tinker AFB (FA8111). If the First Article Report is approved and approval notification has been sent by the Contracting Officer, the contractor will ship the two each First Article exhibits to be forwarded to USAF supply
(SW3210). The contractor shall not proceed with the production quantities until notice of First Article Test Report approval is received.
The First Article offered must be manufactured at the facilities in which that item is to be produced under the contract, or if the First Article is a component not manufactured by the contractor, such component must be manufactured at the facilities in which the component is to be produced for the contract. A certification to this effect must accompany each First Article which is offered.

(IAW DAFFARS 5301.9103)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.
The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) The Competition Advocate (CA) at each contracting activity/office (as defined in DLAD 2.101) shall act as the ombudsman and attempt to resolve contractor complaints. DLA AVIATION – AOCA’s CA/ombudsman can be reached at (405) 855-3552, facsimile (405) 734-8129. Complaints which cannot be so resolved shall be forwarded to the HQ through J-72 for resolution by the DLA competition advocate. Each activity is responsible for developing procedures for executing the duties and responsibilities of its local ombudsman.
(d) The ombudsman has no authority to render a decision that binds the agency.

(a) Definitions. As used in this clause—
(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.
(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.
(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.
(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. (c) The Contractor may submit a payment request and receiving report using other than WAWF only when—
(1) The Contracting Officer authorizes use of another electronic form. With such an authorization, the Contractor and the Contracting Officer shall agree to a plan, which shall include a timeline, specifying when the Contractor will transfer to WAWF;
(2) DoD is unable to receive a payment request or provide acceptance in electronic form;
(3) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment; or
(4) DoD makes a payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System).
