Solicitation Number: SPRRA1-19-R-0035

SOURCE SELECTION INFORMATION – See FAR 2.101 and 3.104

The minimum contract quantity is 55 each. The Government will only be obligated to buy the minimum quantity under the proposed IDIQ contract. The maximum quantity of 275 each represents the Government’s anticipated requirement for a five-year IDIQ.

Production Lead-time without First Article Testing is 300 days after contract award (DACA).

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. 2304(c) (1) and FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. For DoD supplies, this authority is extended to include “only one or a limited number of responsible sources.”

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE

ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE

The Aviation and Missile Research, Development and Engineering Center (AMRDEC) Breakout Engineers have assigned the Acquisition Method Reason Code (AMRC) “2Q” thereby restricting the manufacture of the item from only approved sources. The approved sources have the unique design capability, engineering skills, and manufacturing knowledge to produce this item.

Breakout Engineering has assigned Acquisition Method Code (AMC) “2”, which states the requirement should be “suitable for competitive acquisition for the first time”; the Acquisition Method Suffix Codes “Q” states “The Government does not have adequate data, lacks rights to data, or both needed to purchase this part from additional sources.”

Further, Boeing Company, Cage Code 77272 and W. R. Davis Engineering Limited, Cage Code 3AB25, are the only approved sources that the Government is aware of at this time that has the experience and in-depth knowledge for specifications for the item NOUN: HEAT EXCHANGER, AIRT, NSN: 1660-01-663-6692. These are the only known firms approved to provide the supplies described in Paragraph III above without experiencing unacceptable delays in fulfilling its requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement was synopsized on 29 October 2018 on Federal Business Opportunities (FedBizOpps) as required by FAR 5.201. The extent of competition anticipated are the source identified in paragraph II. In an effort to obtain maximum competition, the synopsis encouraged firms to notify DLA that who can produce the item described in paragraph III to identify themselves.

The synopsis encourages firms to seek source approval in order to compete for future solicitations by accessing the AMCOM Competition Management Office website and looking under Standardized Aviation and Missile Source Approval Request (SAMSAR). Improving the competitive status of acquisition include review and screening under the procedures of the DoD Spare Parts Breakout Program, Defense Federal Acquisition Regulation Procedures, Guidance and Information (PGI) 217.7506.

A Sources Sought Synopsis (SSS) in support of Market Research was conducted by DLA to identify potential manufacturing/supply sources, and if future efforts can be competitive or Set- Aside for Small Business. The proposed North American Industry Classification Systems (NAICS) Code is 336413 which has a corresponding Size Standard of 1,250 employees. The SSS was issued to notify companies that DLA, Redstone Arsenal, Alabama, was seeking qualified sources for the acquisition referenced in paragraph III. No responses were received.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.404, it is anticipated that negotiations will be conducted using information other than cost and pricing data from the contractor.

Thorough price analysis will be conducted using available information and approved pricing techniques that will support the contracting office in making a determination that the price paid to the contractor is fair and reasonable to the Government. Based on the foregoing, the Contracting Officer hereby determines the anticipated cost to the Government will be fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR STATEMENT

OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

Market Research, as defined in FAR 10.001, was conducted based on knowledge of individuals within the requirements community. This item was published in the Competition Advocate Shopping List on 30 June 2018. In accordance with DLA Broadcast Acquisition Memorandum (BAM) 2015-27 published on 12 June 2015, Contracting Officers are required to issue a Request for Information (RFI) or Sources Sought notice with the J&A when acquiring supplies and services from only one or a limited number of responsible sources. A Sources Sought synopsis was posted on 22 October 2018, with a closing date of 25 October 2018; no responses were received. In the event a potential candidate identifies themselves within the appropriate time frame, DLA will provide source approval instruction to the newly identified candidate.

It has been determined that the Government’s need cannot be met by an item available in the commercial marketplace;

therefore, FAR Part 12 will not be used.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

The technical data for this part has undergone full screening per the DFARS PGI 217.7506, Spare Parts Breakout Program. The assigned AMC/AMSC is 2Q. This item will be suitable for competitive acquisition for the first time. The Government does not have adequate data, lacks rights to data, or both needed to purchase this part from additional sources. The Government has been unable to economically buy the data or rights to data, although the part has been undergoing full screening for 12 or more months. Breakout to competition has not been achieved, but current, continuing actions to obtain necessary rights to data or adequate, re-procurement technical data indicate breakout to competition is expected to be achieved. Re-screening will occur on the item identified in paragraph III prior to the expiration date of the AMC/AMRC and no orders will be issued until after the AMC/AMRC has been re-validated. The AMRC expiration date is 14 March 2021. There are no pending Source Approval Request (SARs) on this NSN.

The technical factors supporting the recommendation for other than full and open competitive acquisition are based on review and analysis information residing in the Commodity Command Standard System National Stock Number Maintenance Data Record and the Aviation Acquisition Engineering Part Number Files.

This OEM is not willing to sell data rights to the Government, which means the technical data package, specification, and engineering description suitable for Full and Open Competition cannot be developed without reverse engineering. The Government has determined that reverse engineering is cost prohibitive.

There is no procurement history of NSN: 1660-01-663-6692. This acquisition is the new/improved version of the 01-586- 6051 Heat Exchanger which will eventually replace the current configuration.

OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR

THE SUPPLIES

Firms/suppliers are encouraged to seek source approval in order to compete for future solicitations by accessing the website amcomdmz.redstone.army.mil/casl cmo/casldba.casl cmo samsar and looking under Standardized Aviation and Missile Source Approval Request (SAMSAR). Currently, there are no outstanding qualification requests on this item;

however, this is a continuous method of identifying potential new sources of supply.
