This action will result in the award of a new contract, which will be a firm-fixed price, Five year, Indefinite Delivery Indefinite Quantity (IDIQ) contract. This requirement will be solicited as a Total Small Business Set-Aside using limited competition between the following approved small business sources:

W and G Machine Company, Inc. Cliffdale Manufacturing LLC 4 Hamden Park Dr. 20409 Prairie St.

TOTAL POTENTIAL CONTRACT VALUE

The minimum delivery order quantity is 825 each. The Government is obligated to procure the Base Year quantity of 825 each under the proposed contract. The maximum quantity of 4,260 each represents the Government’s anticipated requirements for the total period of performance. The estimated Production Lead-time is 540 days after receipt of order (DARO).

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, , Only Limited Responsible Sources exist to provide these supplies and No Other Supplies Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTORS’ UNIQUE QUALIFICATIONS OR NATURE OF THE

ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE

The Aviation and Missile Research, Development Engineering Center (AMRDEC) Breakout Engineers have assigned the Acquisition Method Reason Code (AMRC) “1C” thereby restricting the manufacture of the item from only those sources approved by the design control activity. The approved sources have the unique design capability, engineering skills and manufacturing knowledge to produce the items.

Breakout Engineering has assigned Acquisition Method Code (AMC) “1”, which states, “Suitable for competitive acquisition for the second or subsequent time,” and the Acquisition Method Suffix Code “C” states, “This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved sources(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity’s procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application.

Accordingly, Sikorsky Aircraft Corp., as a Large Business will not compete on a Total Small Business Set-Aside. However, W and G Machine Co., Rotair Industries, and Cliffdale Manufacturing, each a certified small business, are approved to provide the supplies described in Paragraph III above without the warfighter experiencing unacceptable delays in fulfilling its requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement will be synopsized on Federal Business Opportunities (FedBizOpps) as required by FAR

5.201. Competition is anticipated from the multiple small business sources in paragraph II and VIII.

In an effort to obtain maximum competition, the synopsis will encourage firms/suppliers that recognize and can produce the item described in paragraph III to identify themselves.

The synopsis will encourage firms/suppliers to seek source approval in order to compete for future solicitations by accessing the AMCOM Competition Management Office website:

http://acmcomdmz.redstone.army.mil/casl omo/casldba.casl omo samsar and looking under Standardized Aviation and Missile Source Approval Request (SAMSAR). The objective is to improve the competitive status of future acquisitions through review and screening in accordance with the procedures of the DOD Spare Parts Breakout Program, Defense Federal Acquisition Regulation Procedures, Guidance and Information (PGI) 217.7506.

A Sources Sought Synopsis (SSS) in support of Market Research was conducted by the Defense Logistics Agency to identify potential manufacturing/supply sources, and to determine whether future efforts can be more competitive and/or Set- Aside for Small Business. The proposed North American Industry Classification Systems (NAICS) Code is 336413 which has a corresponding Size Standard of 1,250 employees. The SSS was posted on 11 September 2018 to notify companies that the Defense Logistics Agency, Redstone Arsenal, Alabama, was seeking qualified sources for the acquisition referenced in paragraph III. No responses were received.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In the absence of competition the contractor will be required to provide other than certified cost or pricing data pursuant to FAR Part 15.4 to support its proposed pricing. The proposed pricing may be negotiated in accordance with the procedures found in FAR Part 15. Based on the foregoing, the Contracting Officer hereby determines the anticipated contractual price to the Government will be fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR STATEMENT OF THE

REASONS MARKET RESEARCH WAS NOT CONDUCTED

Market Research as defined in FAR 10.001, was conducted. The part being procured is an automatic hydraulic or pneumatic device. It is designed to prevent damage to airframe components or structure through suppression of mechanical motion (flutter), caused by aerodynamic or mechanical forces, thereby minimizing maintenance and repair. This item was listed and appeared in the Competition Advocate Shopping List database as of 30 June 2018. A Sources Sought Notice was posted on 11 September 2018, and no responses were received. Had a potential candidate been identified, a Source Approval Request (SAR) would have been required to determine the vendor’s technical capabilities to manufacture the item.

It has been determined that the Government's need cannot be met by an item available in the commercial marketplace; therefore, FAR Part 12 will not be used.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

The technical factors supporting the recommendation for other than full and open competitive acquisition of this item are based on a review and analysis of the available technical data associated with this part per the requirements of DFARS PGI 217.7506, Spare Parts Breakout Program. In addition a full screening of the available technical data was conducted which determined that competition cannot be enhanced, at this time, beyond the existing sources. The Acquisition Method Code (AMC)/Acquisition Method Suffix Code (AMSC) [1C] reflect the technical analysis resultant of this review. There are no pending Source Approval Request(s) (SARs) on this NSN.

This OEM is not willing to sell data rights to the Government, which means the technical data package, specification, and engineering description suitable for Full and Open Competition cannot be developed without reverse engineering. The Government has determined that reverse engineering is cost prohibitive.
