It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

A technical review, which consisted of searching several Government databases including ITIMP, ERP/ORACLE/FMT, ISEA, NSDER, and CDMD- OA has been completed on this item. Search criteria included Part Number, Design Control Activity, CAGE Code, NSN, Nomenclature, RMC/RMSC, AAC, criticality coding, recorded approved sources f supply, historical sources of supply and past contracts. Based on this market research, the contracting officer has determined that there is only one source, CAGE NUMBER: 0WEC9 - VENDOR NAME: EFW INC. If a company other than the one listed believes they have a compatible product, they can submit their documentation to the Program Office, to include research and development, drawings and test specifications. The Program Office may request further documentation of capabilities. The Program Office may also require a site visit, to evaluate a potential source's capabilities to adequately accomplish the procurement for these items. Upon qualification, the approved company will be able to participate in future solicitations.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This item has been procured on a non-commercial basis in the past and is for a specific military application. However, the total estimated cost is lower than the threshold for providing certified cost or pricing data as provided for in FAR 15.403-4(a)(1). Any necessary price analysis or cost information will be used to support the reasonableness of the price.

History

This is the first procurement utilizing the authority of 10 U.S.C. 2304 (c)(1) for NSN 5895 016201068. To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also, future requirements will be advertised on the government-wide point of entry. The Government will include a clause in this solicitation which provides that the Government will consider alternate offers, and that alternate offerors should submit a source approval request (SAR) package that will be referred to the cognizant engineering activity. The current procurement cannot be delayed in order to allow sufficient time for the engineering activity to determine whether to approve any alternate offer. The SAR package will be considered for future awards. This item has been reviewed under the NAVSUP WSS limited screen process and determined that the item cannot be broken out.
