The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.
This acquisition will be solicited to
TEKTRONIX INC (CAGE 80009). Based on the market research performed by the technical representative, it is concluded that the only source of procurement is TEKTRONIX INC (CAGE 80009). It has been deemed uneconomical to pursue the acquisition of the technical data. There are no authorized substitutes of this item as this is the only item known to meet performance and compatibility requirements. The government does not own the technical data needed to support full and open competition. There is one approved source listed in ITIMP and in WebFLIS: TEKTRONIX INC.-CAGE 80009. There are countless prior DLA spares procurements for this item in ITIMP, which were awarded to Tektronix-80009. The TEKTRONIX INC (80009) OSCILLOSCOPE is used to Oscilloscopes in aerospace and defense need to perform regular and consistent validation, characterization, and advanced debugging. Oscilloscopes can be used to determine whether a malfunctioning instrument is distorting an important signal. This item is held to a higher level of inspection criteria which has only been matched by Tektronix-80009 as of now.

The proposed contract action was synopsized on the government-wide point of entry on 05/15/2020 and as a result No responses were received.
Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows
A technical review, which consisted of searching several Government databases including ITIMP, WebFLIS and ERP, has been completed on this item. Search criteria included Part Number, Design Control Activity, CAGE Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved source of supply, historical sources of supply and past contracts. Based on this market research, the Contracting Officer has determined that the only known procurement source for this item is TEKTRONIX INC (CAGE 80009). This product is made up of part number TDS3012C-NV, which is commercial product. If a company other than the one listed believes they have a compatible product, they can submit the item to the Engineering Program Office, to include research and development, drawings and test specifications. The program office may test and evaluate the item at the company’s expense, when appropriate. Upon qualification, the approved company will be able to participate in current or future solicitations. The review in ITIMP included reviewing award history and other potential sources of supply, AMC/AMSC code, part number, CAGE code. In ERP, the search criteria included part number, design control activity, CAGE code, NSN, Nomenclature, AMC/AMSC, AAC, and

History
Criticality Coding, which all matched with ITIMP. All previous award history is to TEKTRONIX, Inc. SPRMM1‐20‐Q‐TB96 was previously synopsized for one day and the solicitation was released on 28 April 2020 with one response from ValueTronics International, Inc, CAGE 4AAA0. ValueTronics provided no additional information with their quote and was more than three times the unit cost from our last procurement in January 2020.
The Contracting Officer hereby determines that the anticipated cost to the Government for this contract action will be fair and reasonable.
This item has been procured on a non-commercial basis in the past and is for a specific military application. However, the total estimated cost is lower than the threshold for providing certified cost or pricing data as provided for in FAR15.403-4(a)(1). Any necessary price analysis or cost information will be used to support the reasonableness of the price. Due to the poor SPRS delivery performance score for Tektronix Inc., the contract shall include the following provision to provide adequate protections and guarantees for timely delivery:
“Delays in deliveries shall be subject to financial reduction in unit prices per DLAD 43.102.”
To promote competition the NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines.
The Government will include a clause in the solicitation that provides that the Government will consider alternate offers, and that alternate offerors should submit a source approval request (SAR) package that will be referred to the cognizant engineering activity. Also future requirements will be advertised on the government-wide point of entry in order to encourage potential vendors to submit SAR.

Oscilloscope TDS3012C-NV is a portable set for displaying a luminous plot of the time variation of a voltage pulse or wave, with self-contained means for measuring its duration, displacements and instantaneous magnitude of all portions of its shape. The oscilloscope is primarily intended for use in testing of all types of electronic equipment. This item requires a higher level of inspection which as of now has only been met by TEKTRONIX INC (CAGE 80009). The drawings of this item are inaccessible at the re-procurement level and thus it has been determined that TEKTRONIX INC (CAGE 80009) is solely qualified to manufacture this item to Navy standards and specifications.
