This J&A is based upon the authority of 10 USC 2304(C) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1

Acquire, for the second or subsequent time, directly from the actual manufacturer.

A/RMSC C

This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

Bogue Systems, Inc. (CAGE 0BXF1) Bogue Systems is the only approved source of supply capable and authorized to manufacture this power module assembly. There are no authorized substitutes of this item as this is the only item known to meet the performance and compatibility requirements within the higher assembly. The item has to be tested within the upper assembly and qualify within approved testing specifications procedures, embedded coding procedures, design protocols, and internal QA requirements.

A Request for Information / Sources Sought Notice was entered on the government-wide point of entry on 07/17/2019 and as a result No other sources were identified as being capable of manufacturing this material. No additional vendors expressed interest in providing Bogue Systems Inc. part number A-57160.

The proposed contract action was synopsized on the government-wide point of entry on 02/04/2020 and as a result TBD

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

A technical review, which consisted of searching several Government databases including ITIMP, FLIS and ERP, has been completed on this item.

Search criteria included Part Number, Design Control Activity, Cage Code, NSN, Nomenclature, AMC/AMSC, AAC, Criticality Coding, recorded approved sourced of supply, historical sources of supply and past contracts. In addition, the contracting office conducted its own independent market research. This market research included a sources sought notice, a review of past awards and any offers, a review of mandatory sources of supply, and a review of WebFlis. Based on this market research the contracting officer has determined that the only known manufacturing source is Bogue

Systems, Inc. (CAGE 0BXF1). If a company other than Bogue Systems believes that they have a compatible product, they can submit the item to the Engineering Program Office, to include research and development, drawings, and test specifications. The program office will test and evaluate the item at the company’s expense. Upon qualification, the approved company will be able to participate in future solicitations.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable. The estimated price of this requirement is below the TINA threshold. Certified cost and pricing data will not be required for a procurement under the TINA threshold in accordance with FAR 15.403-4(a)(1). Comparison to historical pricing of same or similar items and any other means allowed by regulation, will serve as the basis for determining that the proposed pricing is fair and reasonable. A review of other than certified cost and/or price data may result in negotiations being conducted as necessary.

To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines.

Also, future requirements will be advertised on the Government point of entry (https://beta.sam.gov) in order to encourage potential vendors to submit Source Approval Requests. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requires is feasible.

Item description: This power module assembly is a part of the Current Limiting Device (CLD). The CLD imposes an upper limit on the current that may be delivered to a load with the purpose of protecting the circuit generating or transmitting the current from harmful effects due to a short-circuit or similar problem in the load. This item is an integral part of the AEGIS Combat System, which uses powerful computer and radar technology to track and guide weapons to destroy enemy targets.
