IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND

OPEN COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One or a Limited Number of Responsible Sources and No Other Type of Supplies or Services Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

CITED ABOVE

The AMC/AMSC code for this requirement is 4N. Due to the critical application of this item, this part requires engineering source approval by the design control activity in order to maintain the quality of the part. The structural and functional integrity of this item can be affected by individual manufacturing processes and techniques. To ensure continued product integrity of the item, procurement is restricted to approved sources listed in the government’s screening analysis worksheet. An alternate source must qualify in accordance with the design control activities Manufacturing Qualification Requirement (MQR), as approved by the cognizant Government system Engineering activity.

The CEAR on the UMTE weapon system, AN/TPT-T1(V) is a critical component for the system.

The UMTE generates radio frequency energy to simulate enemy radar systems for pilot training.

The CEAR-UMTE is a replacement for the obsolete Electronic Attack Receiver (EAR), UMTE variants, used in the legacy UMTE systems. The CEAR is a specialized subsystem to match the various UMTE Threat Kits functional, fit, form, and interface requirements of the UMTE EAR but utilizes current technology and hardware. Failure to procure a CEAR-UMTE that matches the electrical interfaces could damage the remaining subsystems in the UMTE Threat Kits and cause increased expenditure of maintenance labor hours and cause loss of critical and lifesaving warfighter training. Contractors other than SRC will need to submit a qualification package in the form of a Source Approval Request (SAR). The SAR will need to cover all qualification requirements listed in the MQR document associated with this CEAR-UMTE.

In addition, the Technical Data Package (TDP) requires testing using proprietary test equipment developed and owned by SRC to verify correct operation of the CEAR. Manufacturing sources need to show that they either have access to this test equipment or that they have access to test equipment that can satisfy the test requirements called out in the TDP.

To facilitate the above testing, contractors other than SRC will be required to produce a first article which will be subject to contractor and government testing as called for in the test documents. These tests must include use of the proprietary SRC test equipment, test with government jammer pods, and system tests on all 7 variants of UMTE; system tests may also include testing with aircraft.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

A. A combined Request for Information/Synopsis document (SPRHA5-18-R-0632) was posted to the Federal Business Opportunities website at www.fbo.gov advising industry of the pending acquisition and soliciting inquiries from interested parties. This document was posted on 12 April 2018 and closed on 27 April 2018. Colorado Engineering Inc (3FPR8) and Northrop Grumman – Amherst Systems Inc. both showed interested in this RFI. These contractors would need to submit a Source Qualification Package in order to attempt becoming an approved source.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The cost of this acquisition will be fair and reasonable. Actions anticipated to ensure reasonableness of the price will be accomplished with procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 – Cost Accounting Standards, Part 31 – Contract Cost Principles and Procedures, Subparts 15.4 – Contract Pricing, as appropriate.

Further actions will be under the guidance of the Contract Pricing Reference guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. This is a competitive, restricted source acquisition, with a limited number of approved sources. DLA will obtain certified cost and pricing data IAW FAR Subpart 15.403 as applicable if adequate price competition does not exist. Detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations or discussions.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

A. As described in Section VI above, market research, IAW FAR Part 10, was conducted by posting a combined Request for Information/Synopsis document to Federal Business Opportunities, advising industry of the pending acquisition and soliciting inquiries from interested parties. Colorado Engineering Inc (3FPR8) and Northrop Grumman – Amherst Systems Inc. both showed interested in this RFI. These contractors would need to submit a Source Qualification Package in order to attempt becoming an approved source.

B. On January 17, 2018 a search and review of Google (http://www.google.com) and (http://Thomasnet.com) internet sites was accomplished, in which no additional sources were identified.

C. The government contacted SRC, Inc. and Northrop Grumman Amherst Systems (NGAS) regarding their interest in manufacturing the UMTE CEAR. NGAS is interested and will need to submit a qualification package in the form of a Source Approval Request (SAR). The SAR will need to cover all qualification requirements listed in the MQR. SRC has manufactured seven CEAR-UMTE units that are currently installed in UMTE systems at Eielson AFB, Volk field ANGB, and Nellis AFB.

D. This item has not been identified as “commercial” per FAR part 2.101 and DoD Commercial Item Handbook. There are no known commercial items that can suffice for this application. The UMTE-CEAR assembly is specific to the UMTE system.

E. Based on market research conducted, there is a high level of confidence that there are no additional sources currently capable of satisfying the agencies needs nor are there any other commercial or non-developmental items which could be utilized or which could be modified to meet the Government's needs.

The Contracting Officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12)).

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by the required design control documents included with the package as submitted by the cognizant Government engineering activity, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
