B. Total estimated cost is: $ . This estimate is based on USAF mission requirements of the past two years and the computed D200 Requirements Determination System. This action will use working capital funds.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 USC 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source or a Limited Number of Responsible Sources and No Other Type of Supplies or Services Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITEDABOVE

(APPLICABILITY OF AUTHORITY)

A. The above authority was selected because Lockheed Martin Corporation is the only known source with technical data to produce these components. A complete data package is necessary to provide adequate technical information on specifications, tolerances and material, which are required for another manufacturer to produce an identical item in order to ensure system integrity. Lockheed Martin provided the Government with a Rough Order of Magnitude (ROM) estimate to provide documentation required to facilitate the test and debug of the module assemblies with restricted rights only to allow the Government to develop a capability to test and repair these items at WR-ALC. The limited rights does not authorize the Government the use of the data for competitive procurement. The 416th SCMS procured schematics from Lockheed Martin in 2013 with limited rights, which are limited to Government use only and cannot be released outside of USAFcontrol.

B. The Government lacks sufficient data and license rights to allow for full and open competition to procure these circuit card assemblies. Reverse engineering of these items would be required for another vendor to accomplish manufacture requirement. The cost of reverse engineering this requirement is estimated at $ . These costs include development of new test requirements documents through reverse engineering or redesigning the circuit card. A new or redesigned circuit card would have to go through a full environmental and flight test, which is estimated to take two (2) years.

C. Therefore, an acquisition method code of 3R has been assigned to the Single Board Computer (SBC) Circuit Card Assembly, Data Link Processor (DLP) Circuit Card Assembly and the Graphic Video Module (GVM) Circuit Card Assembly and an acquisition method code of 3N has been assigned to the ALM Circuit Card on the 761 screening.

VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARESOLICITED

FROM AS MANY POTENTIAL SOURCES AS DEEMEDPRACTICABLE

A. A combined Request for Information/Synopsis (#SPRHA4-19-R-1501) was posted to the Federal Business Opportunities website at www.fbo.gov advising industry of the pending acquisition and soliciting inquiries from interested parties. This document was posted on 17 January 2019 and closed on 2 February 2019. No responses were received from any interestedparties.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THEANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost and pricing data to be used in supporting the Government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Audit Agency (DCAA) and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15. Based on the foregoing, the Contracting Officer hereby determines the anticipated cost to the Government will be fair and reasonable.

VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A

STATEMENT OF THE REASONS MARKET RESEARCH WAS NOTCONDUCTED

A. As described Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

B. In addition, the 416th SCMS/GUEA Integrated Product Team (IPT) which consists of the Program Manager, Item Manager and the System Engineer conducted market research as follows:

During the month of September 2019, conducted a review of electronic sources to include: DoD Emall, ThomasNet, ILSmart, HIS Haystack Gold and Pinpoint. These searches were based on nouns, NSNs and part numbers. No interchangeable or substitutable items were identified as a result of these searches and none of the necessary data documents to compete this effort or to qualify another source of manufacture could be found.

Contacted knowledgeable individuals in Government regarding market capabilities to meet requirements. The IPT through market research, process capabilities visits and years of combined professional knowledge of the A-10 CICU weapon system, have concluded with a high level of confidence that there are no additional sources capable of meeting the Government’s needs.

Requests to purchase/license rights to the technical data for these items have resulted in no bids from the OEM. Lockheed Martin did not respond to the request which is interpreted by the government as their unwillingness to sell/license the data. The most recent inquiry made to Lockheed Martin in regard to selling/licensing their data occurred between September 2018 and December 2018. The contracting officer from the Air Force, Sean McKenzie, sent Lockheed Martin numerous emails during this period regarding the data but never received a response. In addition, the commander for the 416th SCMS, Lt. Col. Whittaker, was contacted directly by a program manager, Becky Shuey, from Lockheed Martin who stated that they have no interest in selling their data rights.

C. Based on the market research conducted, there is a high level of confidence that there are no additional sources capable of satisfying the agency's need for this proprietary item nor are there any other commercial or no developmental items which could be utilized or which could be modified to meet the needs of the government.

COMPETITION

ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

The Government will review requests from contractors interested in becoming a qualified source and provide available information to conduct self-funded reverse engineering.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)).

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’SCERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
