JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

A. Upon approval to use other than full and open competitive procedures, DLA Aviation Ogden will issue a new contract to procure two (2) Electronic Switches, used for the F-16 Avionics Intermediate Shop (AIS)/Radio Frequency (RF) Test Stands program by the US Air Force to the following source:

B. Contract Type & Structure: A spares contract with an anticipated Firm-Fixed-Price arrangement will be issued. The estimated award date is 31 July 2017 with performance expected up to 31 August 2018.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED MEETING THE

AGENCY’S NEEDS

A. This item is a component of the F-16 AIS/ RF Test Station that routes, amplifies, and attenuates signals from the RF Test Station to the F-16 Line Replacement Units (LRUs) and from the F-16 LRUs to the RF Test Station.

B. Total estimated cost is: This estimate is based on USAF mission requirements as computed by the D200 Requirements Determination System. This action will use 4930 CSAG-S working capital funds.

COMPETITION

10 USC 2304 (c)(1), as implemented by FAR 6.302-1, Only One Responsible Source or Limited Sources and No Other Supplies or Services will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED

A. The above authority was selected because the government does not own the data or rights to the data needed to purchase this part from additional sources.

B. The 416 SCMS/GUEAA Engineer contacted BAE on 08 FEB 2017 rights status to NSN 5895015983396WF, Part Number

2216905-008. willing to sell or provide government use rights to this data and

. BAE owns the technical data sufficient to manufacture the parts and is unwilling to sell or give permission to the government, to use such dat . The government does not possess the design, data, or license rights required to allow full and open competition for the manufacture and procurement of the Electronic Switch. Therefore, this effort is for continued performance of highly specialized components.

VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

A. A combined Request for Information/Synopsis document (#SPRHA4-17-R-0769) was posted to the Federal Business Opportunities website at www.fbo.gov advising industry of the pending acquisition and soliciting inquiries from interested parties. This document was posted on 15 February 2017 and closed on 2 March 2017. No responses were received in response to the posting.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The cost of this acquisition will be fair and reasonable. Actions anticipated to ensure reasonableness of the price will be accomplished with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing, as appropriate.

Further acitons will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. The Contracting Officer will obtain certified cost and pricing data IAW FAR Subpart 15.403, when required. The final step is to include the Price Negotiation Memorandum (PNM). This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations.

VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS,

OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED:

A. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition. In addition, the 417 SCMS/GUMB Integrated Product Team conducted market research that yielded the following results:

1. On 07 February 2017, a search was conducted on ThomasNet (http://thomasnet.com), an internet site registry, with the NSNs and Part Numbers listed in Section III above resulted in zero results in the product/services, company name, brand name, Computer Aided Design (CAD) drawings and industrial web directories. An internet search was also conducted on Google and IHS Haystack in FEB 2017 with no additional sources were identified.

2. On 08 February 2017, a review of commercial catalogs and other product literature was completed. The review indicated no other alternate commercial item, service, or non-developmental item (NDI), see FAR Part 2, will neither meet the requirement, nor can the requirement be modified to permit use of existing commercial items and /or services or NDIs.

3. The 761 screening action for NSN 5895-01-598-3396WF/Part Number 2216905-008 was reviewed for consistency and reasoning. No discrepancies were found and there is only one approved source, BAE, because the government does not own the data or rights to the data.

B. The 416 SCMS/GUMAA Integrated Product Team market research results indicate with a high level of confidence that there are no additional sources capable of satisfying the agency’s need for this proprietary item nor are there any commercial or non-developmental items which could be utilized to meet needs or which could be modified to meet the needs.
