JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY:

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED:
A. Upon approval to use other than full and open competition procedures, the Government will issue a new contract to procure Removable Mass Memory Devices (RMMD) for the A-10C aircraft, used by the US Air Force to Zodiac Data Systems Inc., 11800 Amber Park Drive, Suite 140, Alpharetta, GA 30009-2269, CAGE Code 1UAE7
B. Contemplated Contract Type: A spares contract to procure a total quantity of 25 each with an anticipated Firm-Fixed-Pricing (FFP) arrangement will be issued. The estimated award date is 30 June 2015 with performance and delivery expected through 30 June2016.

III. DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S
NEEDS:
A. The RMMD contains multiple partitions that are utilized by different functions of the Digital Video Audio Data Recorder (DVADR). The primary partition contains data recorded from the audio and video sources. Maps are loaded to the map partition via the Mission Planning System (MPS) connected to the RMMD. The RMMD installs through the access door of the DVADR on the cockpit right console. The RMMD can easily be changed by the pilot while in flight.

B. Total estimated cost is: $ This estimate is based on the D200 requirements systems Sep 2014 computations. The appropriation code is FC04 funded by 4930 funds as part of the Material Support Division Working Capital fund.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1 -- Only One or Limited Responsible Sources and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED
ABOVE (APPLICABILITY OF AUTHORITY):
A. The above authority was selected because Zodiac Data Systems Inc. is the only known source with technical data necessary to produce this component. A complete data package is necessary to provide adequate technical information on specifications, tolerances and material which are required for another manufacturer to produce an identical item which would ensure system integrity
B. The Air Force owns no rights to the interface and firmware data required to operate the RMMD within the DVADR. Commercial applications of flash memory would require Zodiac’s data, specifically the firmware, to modify interface to work with the DVADR. The last attempt to acquire the data was 26 Mar 2013; negative response received from Zodiac on 23 Apr 2013.
C. February 2013 AF/Engineer approved the use of the 128 GB RMMD as a requirement for the A-10 mission.
D. Therefore, competition for this acquisition is necessarily limited and an acquisition method code of 3R has been assigned on the 761 screening.
VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:
A. Combined Request for Information and Synopsis: A combined Request for Information and Synopsis was posted to FedBizOps, “Combined Request for Information and Synopsis (A-10 Memory Unit)” on 30 December 2014 with a response date of 13 January 2015. DLA Aviation Ogden received a response from Mercer Engineering Research Center (MERC) wondering if they could get an F asset to examine. A response was sent to them with instructions on how to lease an asset. As of 10 February 2015, MERC has not submitted a request or provided a response. No other venders responded and no vendors added themselves to the “Interested Vendors” list on FedBizOps.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
The following steps will be taken to ensure that the anticipated cost of this acquisition will be fair and reasonable. The Contracting officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate. Additional steps to ensure price reasonableness actions will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. DLA will obtain certified cost and pricing data IAW FAR Subpart 15.403, when required. The final step is to include the Price Negotiation Memorandum (PNM). This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion.
VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS
OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED:
A. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
B. Other market research included:
On 12 Jan 2015, Charles Reveal, 416 SCMS/GUMBC, performed market research which consisted of Thomas Register review which provided no evidence of a company that has developed a replacement for the Zodiac RMMD. Several companies that produce digital memory modules for both commercial and military applications were contacted. None have a system that would meet this requirement or that could be modified or ruggedized economically to meet it.
The following sources were contacted:
a. Extreme Engineering Solutions, Madison, Wisconsin
b. Laserdyne VIA Dallas Avionics, Dallas TX
c. IEI/ESA, Talladega AL (A division of Elbit)
C. The market research above indicates there are no commercial items or non-developmental items (NDI) available. The requirement cannot be modified to permit the use of existing commercial items or NDIs.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION:
None

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED:
Hill AFB will review requests from contractors interested in becoming a qualified source and provide available information to conduct self funded reverse engineering.
XII. CONTRACTING OFFICER’S CERTIFICATION:
The Contracting Officer’s signature on the Coordination and Approval Document (CAD) evidences that he has determined this document to be both accurate and complete to the best of his/her knowledge.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERIFICATION:
As evidenced by their signatures on the CAD, the technical and our requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
