IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
10 USC 2304 (c) (1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED
ABOVE (APPLICABILITY OF AUTHORITY):
A. The above authority was selected because the government does not own the data rights to the data needed to purchase this part from additional sources.
B. Raytheon developed the MMC starting in 1992 and has been retrofitting fleetwide under Mid-Life Update/ Common Configuration Implementation Program (MLU/CCIP), with MMC LRMs. This module is an intergal part of the MMC. The operational flight program is developed by Lockheed Martin. Therefore, an AMC/AMSC code of 1R has been assigned to this NSN.
C. We have set up a limited organic repair capabilities for about half of the modules used in the MMC LRU. This part is not used in the USAF F-16 configuration, today.
D. The FMS countries acquiring these items are not interested in and will not fund reenginerring efforts by a new vendor. Any effort to reengineer this part would have technical risks associated with it. Additionally, The 416 SCMS/GUEAA Engineer determined that reverse engineering cost to develop a qualification package and encourage competition are estimated at $4,443,648.00. This cost was computed using estimates for lab analysis, parts destroyed, drawing proofs, special testing, technical order revision and logistics.
E. Accordingly, Raytheon and Lockheed Martin are the only firms capable of providing the supplies and services described in Section III above without the government experiencing substantial duplication of cost that could not be expected to be recovered through competition.

This document was posted 08 January 2015 and closed 23 January 2015. No responses were received from industry.
B. Other actions: None

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations.
VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS,
OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED:
A. As described in section VI above, market research, in accordance with FAR Part10, Market research was conducted by a Combined Request for Information/Synopsis advising industry of the pending acquisition and soliciting inquiries from interented parties. In addition Lane Wilson, Engineer, conducted market research on July 20, 2014. Market research consisted of
1) Request for information (RFIs) 2) Request for proposal (RFPs) 3) Commerce Buisness Daily Reviews (CDB Reviews).
B. The results of the market research concluded that with limited proprietary documents and lack of system/component configuration Raytheon/Lockheed are the only sources capable of supporting all of the MMC units in the multination F-16 aircraft. Raytheon is the only vendor currently producing these items and are the only vendor that have the re-manufacturing capacity for the MMC line replaceable modules (LRMs) today.
