JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART I - Description of Item Required:

PART II - Technical Information and Certification

1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source for the above item is:

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data:

The Technical Data Package (TDP) acquisition production specification data for items #1 and #2 used in DSESTS Combined Functions Module (CSFM) and DSESTS Tow Electronics Module (TEM) not fully defined. At this time, there is no process underway by which complete competitive technical data may be obtained in a time frame necessary to support a competitive procurement process for these spare parts requirements.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:

The costs associated with engineering, testing and the other tasks required to qualify a new source for either items #1 or #2 would easily exceed the total cost of this contract by an order of magnitude. The application development, including any reverse engineering; and operational qualification acceptance testing would include testing of a item #1 in DSESTS CSFM against all Line Repairable Unit that DSESTS presently tests for all variants of both the Bradley and Abrams vehicles.

This extensive testing would have to be conducted utilizing the present software owned in whole by DRS-TEM.; The delay associated with these efforts as well as the complicating factor of proprietary software is unacceptable in fulfilling Army requirements and would have significant detrimental impact on Army’s ability to support the soldier in the field. Additionally, one of each variant of each LRU’s in condition code “A” would have to be located to make the testing possible.

The costs for competition of item #2 utilized for testing of all Bradley TOW missile electronics while not as extensive as that of item #1 would require contracting with DRS TEM to provide a competitive TDP as the present drawing is simply source controlled (i.e. proprietary) to DRS TEM at this time with virtually no technical detail of any sort on the drawing.

c. Demonstration of Approved Contractor's Unique Qualifications: DRS Test & Energy management is the prime contractor for DSESTS, is the sole proprietary owned of the software by which the CSFM (containing item #1) tests vehicle LRU’s and developed, tested and fielded all DSESTS and CSFM units in existence. Similarly, DRS developed and tested the TEM (containing item #2) fielding units as necessary to test and fault isolate all Bradley variants utilizing the TOW missile.

d. Efforts to Qualify Additional Suppliers for future procurements:

No contractors are in the process of becoming qualified for the CSFM or any other DSESTS module at this time.

Qualifying a new source would require a substantial expenditure of the limited funding that has been provided to support Abrams and Bradley LRU maintenance development. New sources would require the development of extensive testing and processing procedures. The additional time required for these actions would prohibit delivery of the items in a time frame that would meet the Government’s requirements.

There has not been any expressed interest by any known contractors to become a qualified source to produce this power supply. Interested contractors can seek qualification through the Source Approval Program with the Competition Management Office.

e. Market Research:

This office does not have sufficient technical information available by which meaningful market research can be conducted.

PART IV - Contracting Information

1. Description of Action: The required item will be solicited on Request For Proposals SPRDL1-15-R-0089. It is proposed to negotiate a Firm-Fixed-Price contract with DRS (CAGE:

24290) for their part numbers 12994001-2 & 13011935. See above for rationale for DRS as the sole source contractor for this item.

2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source(s), every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.

3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.

4. The POC for this action is Jeff Mahlmeister, OFFICE SYMBOL: ZGAAC, Ext. 3163.

5. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary to support price reasonableness in accordance with FAR 15.403-3. Certified cost and pricing data will not be obtained for this action (<$700K).
