4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services can satisfy agency requirements.”
5. Reason for Authority Cited: The Circuit Card Assembly, Power Management I/O, will provide inputs and outputs for the power management processor. The power management processor provides the command, control, and communications for the two systems used in the vehicle. Only DRS NIS, LLC has the requisite technical and engineering expertise to perform all efforts required to provide the Circuit Card Assembly, Power Management I/O. DRS NIS, LLC has demonstrated the unique and proven manufacturing capabilities to establish and maintain the processing control required to repetitively produce this item. Additionally, the Government did not provide funding to prepare a fully detailed Technical Data Package (TDP). As such, DRS NIS, LLC is the sole owner of the documents and technical data rights; and the Government does not own proprietary rights to the documents that would be required to produce a competitive TDP.
Due to the lack of performance and technical data available on the Circuit Card Assembly, Power Management I/O, Reverse Engineering is the only recourse the Government could entertain to increase competition through development of a competitive TDP. A significant amount of money would be necessary to reverse engineer, procure and test prototypes, and release the design. The nature of this hardware requires significant qualification testing and system level testing. Ground Vehicle System Center's (GVSC) engineering utilized a Subject Matter Expert (SME) to determine the reverse engineering costs by reviewing the development cost of the current circuit card. The estimated cost and time to reverse engineer the Circuit Card Assembly, Power Management I/O is $6M to perform the various reverse engineering tasks such as the development of requirements, hardware design, integration and fabrication/installation, vehicle testing, and development and validation of the TDP.

The Government would not be able to recover within a reasonable amount of time, through subsequent competition, the duplication of costs involved in either procuring the proprietary data or reverse engineering the item to create a competitive package.
