Acquisition Method Code (AMC): 3 - Acquire, for the second or subsequent time, directly from the manufacturer.
Acquisition Method Suffix Code: (AMSC): B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition is Title 10 United States Code (U.S.C.) Section 2304(c)(1), as implemented by FAR 6.302- 1(a)(2)(ii)(A), “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Reason for Authority Cited: The only component of the Automatic Fire Extinguishing System (AFES) for the vehicles engine compartment is the fire bottle, which extinguishes engine fires and prevents spreading to the crew compartment and injuring or killing a soldier. These two fire bottles per vehicle are a critical survivability component of the M992A2 AFES which operates in a unique military weapons system. The performance of the fire bottle is specialized per Army TACOM Purchase Description, ATPD-2342 Valve and Bottle Assembly, HFC-227ea.
The fire bottles shall have an electrical release for the valve and shall begin to discharge HFC- 227ea within 10ms after receiving the activation signal with 28 volts direct current (Vdc) step input at room temperature, 77°F ±14°F. The valve shall complete discharge of the liquid phase of HFC-227ea within 400ms. Kidde Technologies Inc. and Meggitt Safety Systems have developed, tested and obtained Government approval for this item for application in the M992A2 Field Artillery Ammunition Supply Vehicle system at their own cost. The Government did not fund their efforts in developing and testing this item. Only Kidde Technologies Inc. and Meggitt Safety Systems have the capability to manufacture the fire bottle, perform failure analysis, develop inspection and acceptance criteria for components, and repair/rebuild and test the fire bottle. Installing hardware that has not undergone similar verifications could lead to a failure of the fire bottle under battlefield conditions and could damage the vehicle’s engine, thus rendering the vehicle unable to proceed with its mission function and endanger the life of the crew.
The USG does not own the Technical Data Package (TDP) for the fire bottles. The fire bottles are source controlled to Kidde and Meggitt. Kidde Technologies Inc. and Meggitt Safety Systems are the only approved sources and own their own respective technical data. The Government does not own proprietary rights to the TDP that would be required to produce a competitive TDP. An ECP has been approved to change Pacific Scientific (05167) to Meggitt Safety Systems (05167) on drawing 12496325 since Meggitt Safety Systems acquired Pacific Scientific in 2011. Due to the limited performance and technical data available on the fire bottle, Reverse Engineering is the only recourse the Government could entertain to increase competition the CMO for assistance with the Source Approval Program, Engineering requires successful vehicle level qualification testing to support the approval of a new source of supply and the Government has no plans or funding to complete qualification testing at this time. To date, no other sources have approached this office with questions or comments on how to become a qualified source to produce this item.
8. Market Research: Market research was performed by TARDEC Sustainment Engineering on 14 February 2018 by reviewing vendor catalogs and available product literature published online by Firetrace Aerospace and Fire Pro to determine if commercial items or non-developmental items are available to meet Government's needs or could be modified to meet the Government's needs. While these two sources manufacture fire bottles for heavy duty applications, they are not tailored (fit and function) to be specifically used in the M992A2 engine compartment. Further, since neither of these sources have produced this specific item for the M992A2 platform, they have not completed the necessary testing to become a qualified source as described in section 5.
Both Kidde and Meggitt have confirmed that they still produce the fire extinguishers.
9. Interested Sources: To date, no other sources have written to express an interest in qualifying as a source of supply. Sources Sought Notice 2018-289 was posted to Fed Biz Opps on 16 February 2018 for the Extinguisher, Fire, NSN 4210-01-518-5265, Part Number 474000-210 as required by FAR 5.201. Any responses received will be evaluated by the appropriate office.
