Justification and Approval for Other Than Full and

Open Competition

The Defense Logistics Agency (DLA) Land - Warren is the procuring activity for this action.

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(2), as implemented by FAR 6.302-2, "Unusual and Compelling Urgency."

PART I - Description of Item Required

PART II - Statement of Urgency

1. TACOM has an urgent need for the item described above. They must be procured by the quickest means possible since full and open competition and/or normal acquisition procedures will not achieve the required delivery date. The rationale for citing urgency follows:

a. Description of Urgent Requirement:

This Engine Fan Clutch is required for the M1070 HETA1 Fleet of vehicles in support of dead-lined vehicles and deployments. It was determined on June 23, 2016 that National Item Identification Number (NIIN) 015739081 was no longer procurable until the Original Equipment Manufacturer (OEM) completed testing of an updated build of the fan clutch in July 2017. Once testing was complete, the OEM assigned a new NIIN of 016685049.

The new NIIN was finally provisioned correctly and the ILSC Item Manager was able to submit PRONs on new NIIN in December 2017. Backorders (BO's) have been accumulating since June 2016. Therefore, all BO's from the previous NIIN will need to be filled with the current e-buy. With the sudden spike in demands and lack of response from Oshkosh Defense on supporting current BO requirements, the Government is unable to support the current requirement without an urgent procurement. The fan clutch is an essentiality code ‘C’ item, which will deadline the vehicle if unserviceable or not available. Delivery of these items is crucial to unit readiness and requires expedited delivery to fill all open and anticipated priority 02-03 backorders.

b. Justification of proposed delivery schedule:

Units require delivery of these items to ensure unit readiness and to perform the units’ daily mission. This procurement is to fill all open high priority 02-03 backorders and an aggressive delivery schedule is necessary. If these parts are not received promptly, this will cause the units to be unable to perform their mission.

c. Description of the extent and nature of the harm to the Government if the proposed delivery date is not met:

This item is essential to the entire HETA1 fleet which consists of vehicles. These fleets offer heavy-duty power and extreme performance for the most difficult recovery missions. These fleets are used all over the world and in theater to support recovery missions for the majority of the army's weapons systems, and not having this fan clutch would have a detrimental effect on the fleet if they were dead-lined due to not receiving this part as soon as possible.

1. What is the serious injury (dollars, harm to soldier, etc.) to the Government if the required delivery dates are not met?

Lack of these items will adversely affect unit readiness. These items are coded essential and will render the vehicle Non-Mission Capable (NMC).

2. What impact would this have on the Army’s mission?

If these parts are not received promptly, this will cause the units to be unable to perform their mission programs as the fan clutch is a vital component of the A1 engine. This item causes the fan to spin, pulling air through the radiator to cool the engine coolant. If this is not delivered in the proposed timeframe, the HET engine will overheat and be considered dead-lined; therefore, the Army’s mission stops, and the flow of supplies, cargo, and essential items being transported stops as well. If not delivered, this item will affect the entire HET fleet of vehicles and will cause an extreme detriment to the Army’s mission.

3. What financial impact would this have on the Government and how was this dollar value assigned?

If the e-Buy is not awarded according to the estimated timeframe, and vehicles are dead-lined due to this essential part, the financial detriment to the army will be substantial and could mean the loss of capability in recovering high dollar value weapon systems such as the Light and Medium Tactical wheeled fleets. If these trucks are lost from the army's inventory and not recovered, there would be a tremendous impact on the mission that they support, both through the transportation of supplies and fuel, to the financial loss of a major end-item not being able to be recovered and put back into inventory. The useful life of these fleets is estimated to be at 40 years in inventory, so when vehicles are not recovered, there can be a tremendous strain on the remaining fleet causing a decline in the army's mission when they are lost.

4. Consider and address whether or not any other items that we currently have in stock could fill this requirement and alleviate the immediate need.

There are no other items that could fulfill requirements for this NIIN or act as substitutes.

d. Urgent circumstances requiring the inclusion of an option: N/A

1. Description of Action: Offers to provide the required item will be solicited under Request for Proposals (RFP) SPRDL1-18-R-0236. DLA Land Warren proposes to negotiate a firm-fixed price contract for the following manufacturers' part numbers:

4358272 - CAGE 75Q65 Oshkosh Defense 98E0012S - CAGE 3GYQ8 Horton Inc.

2. Extent of Competition: Due to the urgency of this buy, no further action will be taken to increase competition on this buy. No market survey will be conducted. Further, the procurement will not be synopsized due to the urgency of the requirement.

3. Future buys of this item will be synopsized. Normal procurement procedures will be used following this emergency buy on future replenishment contracts.

4. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable.

The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary. The Contractor will not be required to submit certified cost and pricing data based on the estimated dollar value and because this is a commercial item per exception stated in FAR Part 15.403-1(b)(3).
