JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

Acquisition Method Code (AMSC): 3 Acquire, for the second or subsequent time, directly from the actual manufacturer.
Acquisition Method Suffix Code (AMSC): H AMSC H. The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s).
This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding.
This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
PART II - Technical Information and Certification
1. The U.S. Army TACOM LCMC requires the acquisition of the above item. The only approved source for the above item is:

2. Reasons the item is not suitable for full and open competition:
a. Status of the Acquisition Data:
The customized military grade the Fire Control Switchboard (PN: 57K6557) interfaces with the General Purpose Processor with 1553B & Graphics PMC Circuit Card Assembly (PN: 12474132-2) which is used on the M1A2 Continuous Electronics Enhancement Program (CEEP) Abrams Tank.
The Government has limited rights in accordance with DFARS 252.227-7013 and 7017;
however; the Technical Data Package (TDP) acquisition production specification data is not fully defined because the drawings do not give enough information to actually design the item. Thus, the drawings are inadequate for production without access to GDLS-FP design and procedures.
The customized military grade Fire Control Switchboard was developed and tested at GDLS-FP expense. Thus, GDLS-FP owns the rights to the design.
No contractor other than GDLS-FP has been approved to manufacture and sell this Fire Control Switchboard to the Government.
Based on the above information, sole source procurement to GDLS-FP is the only method of procurement currently available to insure supportability of fielded vehicles.
b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:
There are no current plans to acquire a competitive TDP because funds are not available to acquire the data necessary to support a competitive acquisition. In addition to not having the information necessary to develop a competitive TDP, ARDEC-RI engineer estimates that the cost to develop a competitive package for this item through reverse engineering, qualification procedures and engineering analysis are listed below:.
Estimated costs associated with reverse engineering: $500,000 Estimated time associated with reverse engineering: 24 months
Estimated costs associated with the development of qualification procedures: $300,000 Estimated time associated with the development of qualification procedures: 12 months
Estimated costs associated with the conducting engineering analysis: $800,000 Estimated time associated with the conducting engineering analysis: 24 months
The aggregate cost of reverse engineering; writing the qualification procedures and conducting an engineering analysis would be at least one million six hundred thousand dollars ($1,600,000) which would not be recovered through subsequent competition.
The aggregate delay in the acquisition process for reverse engineering Fire Control Switchboard; the preparation of qualification procedures and for the engineering analysis to determine if a new source met the qualification procedures is at least sixty months. A delay of this scale is unacceptable in fulfilling the army’s requirements and would have significant detrimental impact on the army’s ability to support the soldier in the field; Army readiness; and deadline the M1A2 CEEP Abrams Tank which would cease to function and in turn deprive the Tank crew’s ability to fight and jeopardize crew safety.
Note: This will not be a Government funded reverse engineering effort because the General Dynamics Land System-Force Protection (GDLS-FP) has more than enough customized military grade Fire Control Switchboards available. Thus, if any contractor decides to take on an effort to reverse engineer and/or procure proprietary data, the new contractor will be solely responsible for taking on all of the cost listed in the above paragraphs with “little” to no assistance from the Government.
c. Demonstration of Approved Contractor's Unique Qualifications:
GDLS-FP has the unique experience with the Fire Control Switchboard (PN: 57K6557) required to meet the requirements timeframe to prevent further delay of meeting backorders. No other vendors have been approved for production on this item nor have any other vendors expressed interest in becoming qualified to producing this item.
GDLS-FP has successfully produced this item on numerous occasions. GDLS-FP has the facilities, personnel, technology and ability to deliver this item in accordance with the Government’s requirements.
d. Efforts to Qualify Additional Suppliers for future procurements:
dollar value expected to exceed $750,000.00, Certified Cost or Pricing Data will be obtained in accordance with FAR 15.403-4(a)(1).
